Clearwater, FL Trash & Recycling: Dumpster Rules (2026)

Sec. 284 sets the physical construction standard for any waste receptacle enclosure serving containerized commercial service in Clearwater. The enclosure has to be built and maintained so the dumpster itself is never visible from ground level, and its gate must open wide enough, at least 12 feet of unobstructed access, for a front-end loading refuse collection truck to service it without maneuvering around obstacles. The pad underneath has to be a six-inch-thick reinforced concrete slab sized to the specific receptacle at that location, strong enough to bear the truck's lifting mechanism.

Subsection (4) makes the enclosure a building-code prerequisite: no final building inspection can be signed off and no certificate of occupancy issued for a site that hasn't met these enclosure requirements. Multi-family residential customers face a parallel duty under subsection (4)(a) to enclose recycling containers the same way, screened from any public right-of-way and still reachable by front-end collection vehicles. The director of solid waste/general services can waive some requirements, other than accessibility and location, if a customer shows the receptacle already isn't visible from any adjacent right-of-way because of existing walls, fences or landscaping, or if strict enforcement would cause extreme hardship.

Every enclosure also has to meet the City of Clearwater's engineering specifications under Sec. D of the Community Development Code and City Engineering Index 701, and the customer, not the city, assumes all liability and indemnifies Clearwater for enclosure-related loss or damage that isn't due to city negligence.
