Municipal Code § 8-16-090, in the Health Nuisances chapter, makes it unlawful to throw upon or deposit in any street, alley, sidewalk, or public grounds paper, old clothes, boots, leather, grass, junk cars, straw or hay, trash, or any other thing, except in public receptacles or authorized private receptacles; subsection (B) separately bars any driver or passenger from throwing or depositing litter from a vehicle onto a street or other public place, or onto private property. A related section, § 8-16-030, declares places used or maintained as junkyards or dumping grounds, including sites for wrecking vehicles or storing abandoned automobiles, trucks, or machinery in a way that interferes with others' enjoyment of their property, to be nuisances.

Once a nuisance under this chapter is identified, § 8-16-150 deems the person who caused or maintains it its author, subject to a separate offense for each 48-hour period the nuisance continues after the chief of police gives written notice to abate; § 8-16-160 lets city council order the chief of police to abate a nuisance that is not cleared after that notice, and § 8-16-170 allows the chief of police or the supervisor of streets to summarily abate a nuisance on a street, alley, sidewalk, or public ground without waiting for the 48-hour notice at all. Community Development and the police department jointly enforce these sections against illegally dumped trash, tires, and junked vehicles.
