Casa Grande, AZ Trash & Recycling: Illegal Dumping (2026)

Section 8.08.190, part of the City's solid waste chapter, sets a broad dumping ban with two independent clauses. The first reaches disposal methods, burning, incinerating, burying, dumping, collecting or removing rubbish, garbage, green waste or waste, anywhere within the City limits unless the person holds a special permit; the second reaches the act of throwing, discarding or depositing refuse or waste on a street, alley, sidewalk or vacant ground, or into a canal, irrigation ditch, drainage ditch or other watercourse, with no permit exception at all for that clause.

Because Chapter 8.08 does not write its own penalty for this section, the citywide default in § 1.08.010 applies: any act declared unlawful under the Municipal Code with no specific penalty listed is a Class II misdemeanor, punishable by a fine of up to $750, up to four months imprisonment, or both, at the discretion of the City Judge, and § 1.08.010(A) makes each day a violation continues a separate offense. Section 1.08.010(B) further lets the City treat the dumped waste itself as a public nuisance subject to abatement, independent of any criminal charge, so the City can order the material removed even while a misdemeanor case is pending.
