Town Code section 9-2 makes it unlawful to dump or scatter garbage, trash, yard waste or industrial waste on Davie roads, sidewalks, watercourses or other land, and to leave accumulations after being directed to remove them within 24 hours. Section 9-3 bars dumping on private property. Penalties under section 9-5 reach $500 per violation, each day a separate offense.
Davie treats illegal dumping and littering as a public nuisance with substantial penalties. Town Code section 9-2 ('Littering; accumulation of garbage; failure to remove after notice') prohibits placing, sweeping, scattering, throwing or dumping garbage, household trash, commercial trash, industrial waste, yard trash or landscape trimmings on roads, streets, parkways, sidewalks, beaches or watercourses within Town limits. Subsection (b) makes it unlawful to permit accumulations that constitute a public nuisance or endanger public health or safety, and provides that failure to remove such accumulations 'within twenty-four (24) hours after having been directed to do so' by the public works director, development services director, a police officer or a code enforcement inspector is a violation. Section 9-3 ('Deposit of waste material upon private property prohibited') bars dumping waste on private property and bars placing waste in trash receptacles not owned or leased by the person without the owner's written authorization. Penalties are set by section 9-5: a violation results in a noncriminal citation carrying a fine of five hundred dollars ($500.00) payable to the Town for each violation, with each day a separate offense, and violations are public nuisances subject to abatement and enforcement-board prosecution. Davie also enforces related provisions such as section 9-51 (waste/weeds/debris) and Chapter 16 littering on Town property, and Florida's litter law (F.S. ch. 403) backstops the local rules.
Illegal dumping is reported to Code Compliance (954-693-8237) or the Davie Police; designated officials can order removal within 24 hours. A noncriminal citation under section 9-5 carries a $500 fine per violation, each day a separate offense, and the Town may abate the condition and pursue enforcement-board action. Using someone else's receptacle without written permission violates section 9-3.
