Town Code section 9-77 requires residential, commercial and other waste producers designated by Town resolution to source-separate recyclables and place them in the appropriate recycling container. Section 9-78 bans anyone but the Town's authorized collector from removing recyclables set out for collection.
Recycling in Davie is mandatory for those designated by the Town and is set out in Chapter 9, Article V. Section 9-76 defines recyclable materials as those 'capable of being recycled and which would otherwise be processed or disposed of as solid waste, including, but not limited to, newspapers, glass and aluminum cans and any other recyclable materials as designated by the Davie town council by resolution.' Section 9-77 ('Requirements for collection') requires residential, commercial, industrial, office and all other waste producers of the Town, as designated by resolution, 'to separate the recyclable materials from waste and place materials in the appropriate recycling container on a date as designated.' Section 9-78 prohibits any person, firm or corporation from removing recycling containers or the recyclable materials placed in them from designated collection locations unless previously authorized by the Town, and section 9-79 provides that penalties for unauthorized collection are 'to the extent permitted by law.' Operationally, the Town now uses a hybrid model: while residents are asked to keep source-separating recyclables, the garbage and recycling carts are currently collected by the same truck and taken to the Waste-to-Energy Facility, with materials potentially routed to a recycling facility in the future. Scavenging or removing recyclables set out at the curb without Town authorization violates section 9-78. Failing to source-separate when designated by resolution is a code matter handled by Code Compliance (954-693-8237). Cart and service problems go to Coastal Waste & Recycling (954-580-1292).
