Hoboken, NJ Trash & Recycling: Illegal Dumping (2026)

Section 136-2A(31) of the Nuisances chapter bans depositing or dumping any earth, dirt, rock, rubbish or other article contrary to the chapter upon any public place in the City, a broad catch-all that covers everything from a contractor's construction debris to household junk left on a sidewalk or in a public right-of-way. The dumping ban sits alongside related Section 136-2A provisions: Subsection (14) separately prohibits placing litter, refuse or garbage in a public place outside the collection rules of Chapter 110, and Subsection (2)(b) bars throwing or depositing litter on private premises whether or not the person dumping owns the property.

Subsection (32) adds a related ban on abandoning shopping carts on City sidewalks, streets or roadways. Because Section 136-2B makes it unlawful for any person to commit, maintain or allow a nuisance declared under the chapter, and Section 136-2C treats each prohibited act as a separate violation, a single dumping incident that leaves debris in place over several days can generate multiple citations rather than one. Enforcement agencies named in Section 136-1 include the Health Department, Environmental Services Department Sanitation Inspectors, Hoboken Housing Inspectors, Zoning Officer and Hoboken Police Department, any of whom can issue a citation after observing or being told of illegal dumping in the City.
