Palatine, IL Trash & Recycling: Illegal Dumping (2026)

Sec. 16-4 of the Village Code makes it unlawful to deposit anywhere in the village any uncovered piles of animal excrement, refuse, garbage, offal or carcasses of dead animals, and any such refuse that is buried must go at least two feet below the surface and be disposed of within 24 hours; anything left uncovered is hereby declared to be a nuisance. A companion provision, Sec. 16-5, separately bars burning or burying garbage or refuse anywhere in the village and caps how long refuse may sit and accumulate at ten days before it becomes an unlawful nuisance that attracts flies, vermin or rodents.

Sec. 16-6 closes off the public right-of-way as a dumping option entirely: no garbage, refuse, recycling or landscape waste of any kind shall be deposited in any street, alley or public way except as provided in this Code, meaning only village-sanctioned curbside placement under Sec. 16-3 is lawful. Because Sec. 16-4 and Sec. 16-5 both label a violation a nuisance, the village can pursue dumping complaints either as a straight Chapter 16 code violation or, through the Building Department's property-maintenance authority, as a nuisance abatement matter with its own remedies.

The rules reach any person, so a resident, contractor or commercial hauler that leaves refuse, excrement or a dead animal exposed anywhere in Palatine, curb, yard, alley, vacant lot or right-of-way, falls under one of these three sections regardless of whether the material was ever meant for curbside collection at all.
