RMC 8-1-4(D), "Unlawful Deposit of Garbage or Recyclables," makes it "unlawful to deposit, throw, dump, dispose or place any garbage, recyclables, or yard waste in any lane, alley, street, road or other public way or place in the City," except when placed curbside in an approved container for the next scheduled contractor pickup. The same subsection separately bars dumping on private property owned by another person "without the consent of the landowner or person in possession or control of the real property."

Subsection C similarly prohibits storing or accumulating garbage, recyclables, or yard waste anywhere on public or private property outside an approved can, bin, or cart, with narrow exceptions for properly maintained compost piles and licensed haulers operating in a zoned collection area. Special or hazardous waste dumping is separately and more strictly banned under RMC 8-1-4(G) and (H), covering lab chemicals to PCBs and requiring disposal per State Department of Ecology rules by a licensed hauler.

RMC 8-1-4(O) makes any violation of the section a misdemeanor, subject to the penalties in RMC 1-3-1. Independently, RMC 8-1-6 declares every violation of Chapter 1 a public nuisance the City may abate, with the violator responsible for "removing any unlawful solid waste from the waste stream, including any and all cleanup costs, damages, costs of suit, including attorney's fees and costs for experts." The Planning/Building/Public Works Administrator, through the Solid Waste Coordinator, supervises enforcement under RMC 8-1-5.
