E. Collection of Residential and Multi-Family Recyclables: Any person may collect residential and multi-family recyclables. However, once recyclables are placed at the curbside or other approved point of collection, then residential and multi-family recyclables may be collected only by the City's collection contractor. N. Unlawful Scavenging: Once any garbage, recyclables or yard waste have been set out on the curbside for collection, or at such other location as authorized by the City, ownership of the garbage, recyclables and yard waste passes to the City's collection contractor. It shall be unlawful for any person, other than the City's collection contractor, to remove or collect any garbage, recyclables, or yard waste once it has been set out on the curbside or other approved location for collection.

Full Breakdown
RMC 8-1-3(E) draws a hard legal line at the curb: any person may collect residential and multi-family recyclables before they are placed for pickup, but once recyclables reach the curbside or another approved collection point, only the City's designated collection contractor may take them. RMC 8-1-4(N) backs this with an ownership rule: once garbage, recyclables, or yard waste are set out at the curbside or another authorized location, ownership passes directly to the City's collection contractor, and it is unlawful for anyone else to remove or collect that material.
This closes off informal scavenging of recycling bins for scrap value. The broader collection framework requires every person and property in the City to use the municipal garbage collection system and its contractor under RMC 8-1-3(B), with a minimum service level charged regardless of actual generation unless the Solid Waste Coordinator waives it under 8-1-3(D). Self-hauling of garbage and recyclables to an approved site is allowed only occasionally, meaning not on a regular or scheduled basis and not as a way to dodge the minimum service charge, under RMC 8-1-3(M). 280 or a Utilities and Transportation Commission permit, to collect, haul, dump, or dispose of garbage and recyclables within the City.
Violations & Fines
Removing recyclables from a curbside bin after they've been set out for collection is unlawful scavenging under RMC 8-1-4(N), and unauthorized hauling of garbage or recyclables anywhere in the City is separately unlawful under RMC 8-1-4(A). Both are enforced as misdemeanors under RMC 8-1-4(O), subject to the penalties in RMC 1-3-1, and any resulting public nuisance may be abated with cleanup costs and attorney's fees charged to the violator under RMC 8-1-6.
