Section 8.16.350 obligates any business, including a multifamily dwelling of five or more units, that generates two cubic yards or more of commercial solid waste per week to arrange organics recycling: subscribing to the city's authorized franchisee, composting organic waste on site, or arranging donation or sale of the material at no fee, with documentation available to the City Engineer on request. Property owners may require tenants to source-separate organics to help meet that duty. Section 8.16.360 requires businesses to place green (organics) and blue (recyclables) containers in every indoor and outdoor area where they provide customer disposal containers, using either franchisee-matched container colors or clear labeling of accepted and prohibited materials; multifamily dwellings are exempt from this container-placement and labeling requirement under 14 CCR § 18984.9(b).

Commercial edible food generators face a parallel duty under § 8.16.390: tier one generators since January 1, 2022 and tier two since January 1, 2024 must contract with a food recovery organization or service, may not intentionally spoil recoverable food, must allow the Enforcement Official to inspect records, and must file quarterly food recovery reports. The city may grant de minimis or physical-space waivers from these organics duties under § 8.16.380, each renewable by written verification every five years, and enforcement under § 8.16.440 layers a 60-day notice-to-comply, base fines of $100 to $500, and an appeal hearing under Chapter 1.20 LEMC before civil penalties attach.
