The city is not responsible for debris from professional demolition or removal services, waste generated outside the city, or property regulated by the federal, state or county government, and outside collectors may only share a container by securing a permit or contract from the city council. Sec. 2(a) then makes it mandatory for every occupant, owner or person in control of a home, building or premises that generates solid waste to use the city's collection service; subsection (b) guarantees every residence collection and disposal service at a fee the city council sets by resolution.
The city manager may authorize additional providers to negotiate directly with industrial properties that need special service, or property owned by a federal, state or county government, under the exception in subsection (c). Waste must go into bags or authorized containers under Sec. 3, with a 65-pound weight cap unless the container states otherwise, and any material placed outside an authorized container will not be collected.
Violations & Fines
Sec. 6-2011.12 makes any violation of the solid waste chapter, including skipping mandatory service, punishable on conviction by a fine of not less than $200.00 and not more than $1,000.00, plus up to ten days of community service. Each day a violation continues counts as a separate offense, and the violator must also reimburse the city for any cleanup costs it incurs.
