As of January 1, 2013, every multifamily residence of nine dwelling units or more and as of November 1, 2014, every multifamily residence of two to eight dwelling units shall provide a recycling program pursuant to this section or a city-approved modified recycling program pursuant to section 90-344. The property owner shall be liable for the failure to provide a recycling program or a modified recycling program approved by the city, provided, however, that a condominium or cooperative apartment having a condominium association or a cooperative apartment association shall be liable, rather than the individual unit owner(s), for a violation of this subsection. ... every multifamily residence ... shall be required to use a single-stream recycling process to separate, from all other solid waste, the five following recyclable materials:(1)Newspaper...(2)Glass...(3)Metal food and beverage containers...(4)Other metal containers...(5)Plastics... Full Breakdown

Sec. 90-340 phased in mandatory multifamily recycling: buildings of nine or more dwelling units had to comply starting January 1, 2013, and buildings of two to eight units followed on November 1, 2014. Every covered building must run a recycling program under this section, or a city-approved modified program under section 90-344. Liability for noncompliance falls on the property owner, except that a condominium or cooperative association, not individual unit owners, is liable when the building has an association. Recycling contractors are required to help the public works director identify multifamily buildings with no program or a lapsed program.

Subsection (b) requires a single-stream process separating five material categories from the rest of the solid waste stream: newspaper and glossy inserts; glass jars, bottles and containers (excluding ceramics, window/auto glass, mirrors and light bulbs); ferrous and nonferrous metal food and beverage containers; other metal containers such as paint and aerosol cans; and HDPE/PET plastic bottles, jugs, jars and tubs (excluding film, bags, vinyl, rigid plastic toys and foam). Every covered building must be serviced by a recycling contractor licensed by both the city and the state.

Enforcement under Sec. 90-345 began July 1, 2013, after a six-month warning period, and Sec. 90-346 sets escalating fines of $350, $500, $1,000 and $2,500 for repeated failures to run a program at all.

Violations & Fines

A multifamily property that never sets up a recycling program, or lets one lapse, gets one warning and 30 days to correct it before a notice of violation issues under Sec. 90-345(e). Fines under Sec. 90-346(a) escalate to $350 for a first violation, $500 for a second, $1,000 for a third and $2,500 for a fourth, and unpaid fines become a special assessment lien on the property.
