Kenner Code of Ordinances § 7-97 defines theft of recyclables as the misappropriation or taking of recycling bins or the contents inside them, by anyone other than the original owner, once those bins have been placed curbside for collection as part of the city's recycling program. The section carves out an exception for persons the city has actually authorized to collect that material, meaning licensed city or contracted recycling haulers are not swept in. Because § 7-97 sits in Chapter 7, Crimes, Miscellaneous, and does not itself set a fine amount, the general penalty clause of that chapter, § 7-3, fills the gap: where no specific penalty is stated for a Chapter 7 offense, a violator faces a fine of up to $500.00, imprisonment of up to sixty days, or both, with each day the violation continues counted as a separate offense.

The Kenner Police Department is the enforcing agency for Chapter 7 crimes generally. This bin-theft rule is distinct from the city's separate solid waste and recycling fee ordinance in Chapter 9½, which governs how the recycling program is funded rather than who may lawfully handle bins once they are set out.
