In Lake Elsinore's residential district, LEMC 6.08.020 conclusively presumes more than two chickens (or other fowl/rabbits in aggregate) are kept for commercial purposes, which is prohibited. LEMC 6.08.030 also bans roosters between 6 p.m. and 8 a.m.
Chickens fall under LEMC Chapter 6.08 (Livestock). Within the restricted residential and business district defined in LEMC 6.08.010 (most of the city), LEMC 6.08.020 makes it unlawful to keep chickens, pigeons, geese, ducks, turkeys, or rabbits for commercial purposes, and conclusively presumes any aggregate quantity greater than two is commercial. That effectively limits a household to two such birds kept noncommercially. LEMC 6.08.030 separately bars roosters or male geese, ducks, turkeys, or guineas between 6:00 p.m. and 8:00 a.m. in that district. LEMC 6.08.040(B) bars any fowl habitually making loud noises amounting to a public nuisance. Larger parcels northeast of the LEMC 6.08.010 line lie outside the restricted area; zoning and the County may add rules.
Keeping more than two chickens (presumed commercial) or roosters overnight in the restricted district violates LEMC 6.08.020 and 6.08.030. Such keeping is a public nuisance under LEMC 6.08.010 and is abatable, enforced by Animal Friends of the Valleys.
