Lake Elsinore imposes no breed-specific dog ban. California Food and Agricultural Code 31683 bars cities from declaring any dog dangerous or vicious by breed. The city instead handles individual dogs by behavior under LEMC 6.04.250 and the state Food and Agriculture Code.
No Lake Elsinore ordinance bans pit bulls, Rottweilers, or any other breed. California Food and Agricultural Code 31683 lets cities run dangerous-dog programs but provides that no program 'shall be specific as to breed,' preempting breed bans. Lake Elsinore addresses dangerous animals by conduct: LEMC 6.04.250 lets the Animal Control Officer investigate and Animal Friends of the Valleys hold a hearing under Food and Agriculture Code Section 31601 et seq. A 'potentially dangerous or vicious dog' is defined in LEMC 6.04.010 by behavior, not breed. Health and Safety Code 122331 allows only breed-specific spay/neuter or breeding rules, not bans; the city's spay/neuter ordinance (LEMC 6.06) is not breed-specific. Landlords and HOAs may still set breed terms privately.
There is no breed-based offense. Enforcement is behavior-based: any dog may be declared potentially dangerous or vicious through the LEMC 6.04.250 process. A dog found vicious may be confined, muzzled, leashed, insured, removed, or humanely destroyed, and must be registered.
