Commerce City, CO Building Safety: Carbon Monoxide Detectors (2026)

Commerce City Revised Municipal Code § 5-4201 deletes Section R315.1 of the 2021 International Residential Code, entitled General, in its entirety and replaces it to read that carbon monoxide alarms shall be installed and maintained as required by and in compliance with Article 45 of Title 38 of the Colorado Revised Statutes. The city's property maintenance code carries the identical language at Section 705.1 under Commerce City Revised Municipal Code § 5-4401, so the alarm requirement travels with the C3BC whether the building official is reviewing new construction or Community Development is inspecting an existing rental or resale property.

The city goes further for finished basements used for day care: Section AM105.6, part of the added Basement Habitable Spaces article at § 5-4201, requires carbon monoxide alarms in those basements in accordance with Section R315.1 as amended by the city, alongside the same article's light, ventilation, ceiling-height, guard and egress rules for basement day-care rooms. Because the substantive placement, testing and interconnection standards live in the state statute rather than in city text, a Commerce City inspector checking alarm compliance is directly enforcing the Colorado Revised Statutes provision the city code points to, and any statutory amendment to Title 38, Article 45 automatically updates what the local building official checks for without a separate city ordinance change.
