Mount Prospect, IL Building Safety: Scaffold & Sidewalk Shed (2026)

Section 23.111, Hazardous Objects on Public Ways, is the Village of Mount Prospect's scaffold rule. Subsection A applies to any scaffold or ladder placed in such a position that it overhangs or can fall into any public street, alley or other public place in the village. That equipment must be firmly and properly constructed and safeguarded. The same subsection makes it unlawful to place or leave any tools or articles on any such place in such a manner that they can fall into any street, sidewalk, alley or other public way from a greater height than four feet (4').

Subsection B extends the four-foot line to windows. It is unlawful to place any movable article on any window ledge, or other place abutting on a public street, alley or other place at a height above four feet (4') from the ground, in sidewalk, street, alley or other public place.

The demolition article adds a second scaffolding requirement. Under Section 21.205, no building or other structure is demolished unless a permit is first obtained from the director of community development, and residential accessory structures under two hundred (200) square feet in size are exempt from the permit. The director issues the permit on finding that the application and the proposed operations fully comply with all provisions of the Code. Subsection D then requires all demolition and restoration operations to conform to the Code's safety procedures for occupying streets and making excavations, including lighting, guardrailing, temporary sidewalks and proper scaffolding.

Appendix A, Division III lists both Section 23.111(A) and (B) at $100.00. Section 23.116 sets the fine range for offenses under the general offenses article at not less than $100.00 nor more than $1,500.00 for each offense.
