Davie strictly prohibits commercial vehicles and construction equipment from being parked, stored, or maintained within any residentially zoned district, whether on private property, swale areas, or public or private road rights-of-way, under Town Code Section 12-33(G). Town Code Section 12-33(F) also bars leasing or using a private residential or community garage for a commercial vehicle.
The Town of Davie maintains some of the more restrictive residential commercial-vehicle rules in Broward County. Under Town Code Section 12-33(G), commercial vehicles and construction equipment must not be parked, stored, or maintained within a residentially zoned district, whether on private property, swale areas, or public or private road rights-of-way. The Code defines a commercial vehicle broadly as any vehicle whatsoever designed, intended, or used for profit or for hire, including, but not limited to, cars, vans, trucks, trailers, farm tractors, farm trailers, tow trucks, tractor-trailers, semitrailers, buses, and trailers of any nature. Construction equipment is defined as equipment used in land clearing and development, building, construction, utility construction, or road construction. The Town's regulation references Gross Vehicle Weight Rating (GVWR) vehicle classes (Classes 1 through 8, ranging from under 6,000 pounds up to over 33,000 pounds) used to describe and categorize vehicles. In addition, Town Code Section 12-33(F) provides that no commercial business concerned with motor vehicles shall be conducted in a private residential or community garage, and that space in a private residential or community garage shall not be leased for storage or used by a commercial vehicle. Together these provisions mean that a resident generally cannot keep a marked work truck, van, tow truck, semitrailer, or construction equipment at a home in a residential district, nor rent out garage space to store one. The Town's Code Compliance Division enforces these rules.
Storing a commercial vehicle or construction equipment in a residential district is a Code Compliance violation under Section 12-33(G); the Town issues a Notice of Violation and may proceed to a Special Magistrate hearing with fines and liens.
