Flagstaff, AZ Public Conduct: Aggressive Panhandling (2026)

Flagstaff City Code § 6-01-001-0001 defines 'aggressive manner' solicitation to include intentionally or recklessly touching the person solicited without consent, approaching or following someone in a way likely to cause fear of bodily harm or property loss, continuing to ask for money from within five feet of a person after a negative response, blocking the safe passage of a pedestrian or driver, and using obscene or threatening language or gestures meant to intimidate a reasonable person into giving money. The ordinance separately bans all solicitation, aggressive or not, inside any public transit vehicle or within fifteen feet of a transit stop, bus stop, taxi stand or train station platform; within fifteen feet of a bank, credit union or automated teller machine entrance without the owner's consent; immediately next to a business entrance in a way that blocks entry or exit; within fifteen feet of anyone completing a financial transaction or seated on a business patio without the owner's consent; on private property after the owner has objected or posted a no-solicitation sign; and from anyone under sixteen who is not with an adult.

The Flagstaff Police Department enforces the ordinance citywide, including downtown, along Route 66 and near the NAU campus corridor where panhandling complaints concentrate. Anyone convicted under Flagstaff City Code § 6-01-001-0001.1 is guilty of a Class 3 misdemeanor. The ordinance, enacted by Ordinance 2014-09 on April 15, 2014, exempts constitutionally protected picketing and permitted activity from the obstruction clause, and it targets conduct, not the act of asking for money itself, so asking once without aggressive conduct or a banned location remains lawful in the City of Flagstaff.
