Flagstaff, AZ Public Conduct: Public Marijuana Use (2026)

Flagstaff City Code § 6-10-001-0003 draws a hard line at the edge of City-controlled land: it is unlawful for anyone to smoke, consume, use, sell, cultivate, manufacture, produce, transfer, or distribute marijuana or marijuana products on property that the City of Flagstaff occupies, owns, controls or operates, which reaches City parks, sidewalks, pedestrian thoroughfares, and other public premises defined in § 6-10-001-0002 as 'open space.' The ban is broader than a simple consumption rule; it also reaches sale and cultivation on that same public property.

A related but separate provision, § 6-10-001-0006, criminalizes consuming marijuana or marijuana products while driving or riding in an operating vehicle, boat, aircraft or other vehicle, and layers on its own progressive penalty for anyone under 21: a $100 civil penalty for a first violation, a petty offense with up to eight hours of drug education for a second, and a Class 1 misdemeanor for a third or subsequent violation. Consumption on private property is separately restricted under § 6-10-001-0005 where the property's owner or occupant has given reasonable notice that marijuana use is prohibited there.

Absent a different penalty specified elsewhere in the chapter, a violation of § 6-10-001-0003 is a petty offense heard in Flagstaff Municipal Court under § 6-10-001-0009, and the Flagstaff Police Department is the chapter's enforcing agency under § 6-10-001-0010.
