Flagstaff, AZ Public Conduct: Public Urination (2026)

Flagstaff City Code § 6-01-001-0006 bans urinating or defecating in a public place, unless enclosed facilities are provided, or in any place exposed to public view; it traces to the City's original 1895 ordinance (Ord. 10) and was last revised by Ordinance 2005-22 on December 6, 2005. Because this section does not set its own fine, it defaults to the City Code's General Penalty clause at Flagstaff City Code § 1-04-001-0001: a conviction is a misdemeanor punishable by a fine up to two thousand five hundred dollars and up to ninety days in the county jail, and Flagstaff City Code § 1-04-001-0003 makes each day a violation continues a separate offense.

The Flagstaff Police Department enforces the ban citywide, including downtown around Route 66, Heritage Square and the trail system, where 'enclosed facilities intended for such purposes' means an actual public or private restroom, not a bush, doorway or parking lot. Because the rule reaches any place 'exposed to public view,' officers can cite conduct on private property, in a vehicle, or in an alley if it can be seen by passersby, and there is no exception for intoxication or medical urgency written into the text itself.

The provision sits inside Chapter 6-01, General Offenses, alongside indecent exposure and disorderly conduct, and a public urination or defecation citation commonly accompanies other public-conduct charges when officers respond to a single incident downtown or near the bar district adjacent to NAU.
