Flagstaff, AZ Public Conduct: Loud Party Ordinance (2026)

Flagstaff City Code § 6-08-001-0005 defines a 'nuisance party' as a gathering of five or more people on private property, including a business, that disturbs the quiet enjoyment of private or public property through conduct such as excessive noise or traffic, blocking streets, drinking in public, serving or consuming alcohol by a minor, fighting, or littering. When Flagstaff police first respond to such a gathering and find a threat to public peace, health, safety or welfare, the officer issues a written notice of violation to each 'responsible person' present, meaning any host, sponsor, tenant, occupant or guest who took part.

A second police response to the same premises within 120 days is a second nuisance party, and both the responsible persons and the property owner receive notice and a civil fee. A third or later response within 120 days of the second is billed at the top tier. If minor-in-possession, minor consumption, illegal drug possession, weapons misconduct under A.R.S. § 13-3102, or any felony is occurring at a first or second response, the fee jumps a tier early. Owners are only billed if they were present and failed to act reasonably, or if a subsequent party occurs 30 days or more after the owner received certified-mail notice of an earlier one; an owner can petition the Chief of Police within 10 business days for a waiver by showing eviction efforts, enrollment in the Flagstaff Police Department's Crime Free Multi-Housing Program, or (for properties over 100 units) private security. The ordinance does not attach liability for guests who show up uninvited and whose conduct the host could not reasonably foresee or control.
