Flagstaff, AZ Public Conduct: Outdoor Smoking Restrictions (2026)

Most cities only regulate smoking indoors, but Flagstaff's ordinance, adopted by Ordinance 2005-19 and expanded to cover electronic cigarettes by Ordinance 2018-43, reaches outdoor City property. Section 7-05-001-0003 lists twenty categories of "public place" where smoking and vaping are prohibited, and two of them are entirely outdoors: item 19, park property as defined in Section 8-11-001-0004(A), and item 20, cemeteries as defined in Section 10-80.20.030. The same section also covers enclosed spaces like restaurants, retail stores, sports facilities, and common areas of apartment buildings, but the outdoor items apply City-wide regardless of whether anyone else is nearby.

Section 7-05-001-0005 adds a "reasonable distance" rule: smoking and vaping are barred within a distance sufficient to keep smoke from drifting through doors, windows, or vents into any building where smoking is already banned, and any ashtray or smoking receptacle must sit outside that no-smoking buffer. A handful of narrow exemptions exist under Section 7-05-001-0006, including private residences, up to 20 percent of hotel rooms designated as smoking rooms, private clubs, and Native American religious ceremonies protected under the American Indian Religious Freedom Act, but none of those exemptions covers park property or cemeteries. The City Manager or a designee enforces the chapter, and any resident can file a complaint directly with that office under Section 7-05-001-0010.
