Caldwell, ID Public Conduct: Loitering Rules (2026)

Caldwell City Code section 08-01-27 defines disorderly conduct as a single offense covering ten separate acts, three of which target loitering. Subsection (1)(G) makes it unlawful to loiter in, about or upon any street, alley or other public way or public place, or any place open to the public, without lawful business, while conducting oneself in a lewd, wanton or lascivious manner in speech or behavior. Subsection (1)(J) separately bars loitering, prowling or wandering upon the private property of another without visible or lawful business with the owner or occupants.

Subsection (1)(K) targets loitering or remaining, without a legitimate reason, in or about a school when the person has no relationship involving custody of or responsibility for a student. The same section also criminalizes fighting, obscene gestures, unreasonable noise, begging, possessing burglary tools, unauthorized occupancy of vehicles or structures, public intoxication that endangers others, and peering into windows with intent to invade privacy, so an officer citing loitering conduct may also be weighing these related subsections. The ordinance traces to Ordinance 2759, adopted August 18, 2008, and is enforced by the Caldwell Police Department within the city limits of Caldwell, Canyon County. It applies inside Caldwell only; loitering on unincorporated Canyon County land falls under the county's own code, not this section.
