Caldwell, ID Public Conduct: Public Alcohol Use (2026)

Two Caldwell City Code sections drive this rule. Section 08-07-03 makes it unlawful for anyone to possess an open container of any alcoholic beverage on or upon any street, in any public parking lot, in or upon any public or private motor vehicle, or upon any public or private property open to the public, unless state statute or the article itself permits it. Section 08-07-05 imposes the identical prohibition on actually consuming alcohol in those same locations. Both sections trace to Ordinance 1999, adopted September 7, 1993, and both apply citywide inside Caldwell, not in unincorporated Canyon County.

during an approved event; free drinks served indoors at a private business tied to a specific event; a public sidewalk adjoining a permitted facility under a city council catering permit issued under section 06-07-35; sample-tasting events limited to one and one-half ounces of beer or wine per sample; and beer and wine only, at Wolfe Field ballpark, except on the playing field or in the dugouts. Section 08-07-09 puts the Chief of Police in charge of writing rules to administer the article, subject to City Council approval, and requires permit holders to follow all conditions attached to their special event or catering permit.
