Caldwell, ID Public Conduct: Outdoor Smoking Restrictions (2026)

Section 08-01-29 does not ban smoking in every Caldwell park or public place; it targets a defined cluster of outdoor sports and event venues. It is unlawful to "light, use, or smoke any cigarette, electronic cigarette, cigar, pipe, hookah, or other similar product" at locations "commonly known collectively as the 'Caldwell Events Center,'" which the code names as Simplot Stadium, O'Connor Field House, the Canyon County Fairgrounds, the Caldwell Night Rodeo Arena, the Wolfe Field Baseball Stadium and Gabiola Field. The ban also reaches the surrounding premises and parking lots of those venues, and any other publicly owned property inside a mapped boundary running from 22nd Avenue on the northwest to Blaine Street on the southwest, Linden Street on the southeast and the railroad tracks on the northeast.

Electronic cigarettes are defined by reference to Idaho Code section 39-5702. Adopted by Ordinance 3046 on April 18, 2016, the section makes a violation an infraction carrying a fixed one hundred dollar fine plus court costs, a lighter penalty track than the misdemeanor charges used elsewhere in the city's public offenses article. Because the ban is tied to the mapped Events Center district rather than to "parks" generally, a smoker in Caldwell Memorial Park or another city park outside that boundary is not covered by this section.
