Laguna Niguel sets no short-term rental occupancy or guest limits because short-term rentals themselves are banned in residential zones. There is no lawful STR to which a maximum-guest rule could apply.
Cities that permit STRs commonly cap guests by bedroom count, but Laguna Niguel has no such STR occupancy standard because the use is prohibited. Under LNMC 9-1-32 Table 3.1 and 9-1-142 (Ordinance No. 2017-187, ZCA 16-01), any rental of a dwelling or portion of it for less than 30 consecutive days in a residential district is a Prohibited Use. With no STR permit or program, there is no city-defined maximum overnight occupancy, persons-per-bedroom formula, or daytime-guest cap tied to short-term rentals. General residential density, building, and health-and-safety codes still govern normal household occupancy, but these are not STR rules and create no STR allowance. Lawful rentals of 30 consecutive days or more are ordinary tenancies, not STRs.
Because no lawful STR exists, operating the rental at all is the violation, not exceeding a guest count. It is enforced as a prohibited use and nuisance by Code Compliance. Ordinance 2017-187 required STR use to cease by 2018.
