Laguna Niguel has no host-presence or hosted-versus-unhosted distinction because all short-term rentals under 30 days are banned in residential zones. Being present during a stay does not make the rental lawful.
Cities that regulate STRs sometimes allow only 'hosted' rentals where the owner remains on-site. Laguna Niguel made no such distinction: LNMC 9-1-32 Table 3.1 and 9-1-142 (Ordinance No. 2017-187, ZCA 16-01) prohibit every short-term rental under 30 consecutive days in residential districts, hosted or not. The definition in 9-1-142 reaches the use of 'any dwelling unit or portion thereof' for under 30 days in exchange for compensation, which captures renting a single room while the owner is home. With no hosted-STR permit or home-share program, host presence is legally irrelevant โ the activity is prohibited either way. Renting 30 consecutive days or more is a normal tenancy.
A hosted, owner-present short-term rental is enforced the same as any other prohibited STR โ a zoning violation and nuisance handled by Code Compliance. Ordinance 2017-187 terminated all STR use, hosted or unhosted, with a January 1, 2018 deadline.
