Yorba Linda runs solid waste collection through an exclusive franchise system rather than municipal trucks, and § 8.20.030(A) makes participation mandatory: the owner, property manager, tenant or person in charge of every residential and commercial premises in the city must either subscribe to collection service with the City's franchisee or separately register as a self-hauler and obtain a self-hauler permit. The only built-in exception, under § 8.20.030(B), applies to a residential premises where every dwelling unit sits vacant, or a commercial premises that is entirely vacant, for 90 days or more, and only for the duration of that vacancy; the property owner bears the burden of proving the vacancy to the City Manager's satisfaction.

For occupied premises, § 8.20.060(A) sets the minimum pickup frequency at not less than once per week, whether the waste is removed by the franchisee or by an approved self-hauler. Section 8.20.060(B) adds an independent duty on top of that floor: the responsible party must remove waste often enough to prevent any accumulation from becoming a public nuisance, even if that requires more than weekly service. Where a specific property generates enough waste that weekly pickup isn't enough to prevent a nuisance, § 8.20.060(C) lets the City Manager issue written notice requiring a more frequent schedule, additional containers, or larger ones, tailored to that property's circumstances.

Self-haulers face an added compliance layer: to keep their permit, they must show they diverted at least 50% of their collected waste from landfills, consistent with AB 939's diversion mandate.
