Under YLMC 8.20.070(M), it is unlawful for any person to throw, place, scatter, or deposit solid waste on another person's property or upon any public property, street, driveway, highway, or alley, except as permitted by the chapter. Section 8.20.070(N) separately prohibits depositing waste anywhere in the City in a manner that becomes a nuisance or endangers public health. Scavenging is barred: 8.20.070(L) makes it unlawful for anyone but the franchisee to take or appropriate solid waste, including recyclables, placed in a street or alley for franchise collection. Section 8.20.070(J) prohibits setting waste out without first subscribing, and 8.20.070(H) bars unpermitted third-party collection. Unauthorized containers may be impounded after 24 hours (8.20.120), and open burning of waste is prohibited (8.20.070(K)).
Illegal dumping and scavenging are enforced as Chapter 8.20 violations, chargeable as infractions ($100/$200/$500 for first/second/third within a year) or misdemeanors (up to $1,000 fine and/or six months in jail), with each day a separate offense.
