Parsippany-Troy Hills, NJ Trash & Recycling: Illegal Dumping (2026)

Article V of Chapter 354 of the Parsippany-Troy Hills Township Code, adopted to carry out P.L. 1989, c. 118, sets a volume trigger and then attaches steep penalties. Section 354-28 bars anyone, regardless of intent, from collecting or disposing of solid waste in excess of 0.148 cubic yards of solids or 30 United States gallons of liquids, whether for profit or otherwise, except at a disposal site or other place authorized by the Department of Environmental Protection or the Board of Public Utilities to accept solid waste.

Section 354-29 applies the same volume limits to hauling: no person can transport or cause or permit the transport of that much solid waste to a place that lacks the authorization. Intent is irrelevant under both sections. Under § 354-30, a conviction means a fine of not less than $2,500 for a first offense, not more than $5,000 for a second offense and not more than $10,000 for a third and every subsequent offense, and each day the violation continues is an additional, separate offense.

Section 354-31 requires the court, on top of the fine, to order community service for a term of not more than 90 days and to end the right of the convicted person to operate a motor vehicle on New Jersey highways for not less than six months nor more than one year. Under § 354-32, any member of the Police Department, the Director of Public Works or his designee, or the Health Officer or his designee can enforce the article, and the summons must cite P.L.

1989, c. 118 and the article. Section 354-33 lets the Township Council award $250 or 10% of the fines collected to anyone whose information leads to the apprehension or conviction of a violator. Article VI separately caps deposits in Township-owned waste and recycling receptacles at one cubic foot per day and bars bringing in outside waste, with fines of not more than $2,500 for a first offense and not more than $10,000 for later offenses under § 354-37.
