Full Breakdown

Section 10-12-03-3(7) bans possessing a long list of wild mammals, reptiles and pest insects within Caldwell, but subsection (7)(C) carves out a specific exception for people and organizations doing legitimate wildlife work. S. S. Department of Agriculture. The same exception in subsection (7)(B) extends to animals listed as threatened or endangered at the state or federal level, meaning a permitted rehabilitator handling a protected species is not automatically in violation just because the species also appears on Idaho's or the federal government's protected list. The exception is narrow: it does not legalize keeping a prohibited animal as a personal pet, and it requires the operator to actually hold a current, proper license or permit from one of the named agencies rather than simply claiming rehabilitation intent.

Because the underlying prohibition sits in the zoning code's animal regulations rather than a separate animal control chapter, a wildlife rehabilitation operation in Caldwell also has to satisfy whatever zoning district, setback and enclosure standards apply to the property under the rest of Section 10-12-03-3 and the accessory use standards in Section 10-12-03-1.

Violations & Fines

A rehabilitator, breeder or exhibitor who keeps a prohibited species without a current, proper license or permit from the city, the Idaho Department of Agriculture, the U.S. Fish and Wildlife Service, or the U.S. Department of Agriculture loses the exception and is treated the same as anyone else violating Section 10-12-03-3(7). Under the general penalty clause, Section 01-01-05, that is a misdemeanor punishable by fine and/or imprisonment up to the maximum set by Idaho Code Section 50-302.

Frequently Asked Questions

Can I run a wildlife rehab operation for prohibited animals in Caldwell?
Yes, if you hold a proper license or permit. Section 10-12-03-3(7)(C) exempts rehabilitators who are properly licensed or permitted by the city, the Idaho Department of Agriculture, the U.S. Fish and Wildlife Service, or the U.S. Department of Agriculture from the general ban on possessing those species.
Does the rehabilitator exception cover endangered species too?
Yes. Subsection (7)(B) applies the same prohibition, and therefore the same (7)(C) exception, to animals listed as threatened or endangered at the state or federal level, so a properly permitted rehabilitator can handle a protected species without violating the section.
Can I claim the rehabilitator exception without a permit in Caldwell?
No. Section 10-12-03-3(7)(C) requires the operator to be properly licensed or permitted by the city or one of three named federal or state agencies; simply intending to rehabilitate an animal does not satisfy the exception.
