Before issuing a permit, the director must find the use will not unreasonably interfere with public enjoyment of the area or with public health, welfare, safety and recreation, will not involve violence, crime or disorderly conduct, will not require added city expenditure absent agreement to cover it, that the requested date and hour are not already reserved, that the applicant has not been responsible for two or more violations of the chapter within the prior year, and that the application contains no material falsehood.

Ramada or field rental applications must be submitted no later than 72 hours before the event; the director must notify the applicant in writing of approval or denial, with reasons given for any denial. A permittee may be required to carry liability insurance in an amount set by the city's risk manager, to use city employees for supervision (with those costs added to the permit fee), and to hire additional security or control personnel at the permittee's expense. Permits are nontransferable between persons or locations, and absent a permit in hand it is presumed no permit was issued. The director may adopt further rules and procedures to administer the chapter.

Violations & Fines

A permit may be revoked for violating any rule, ordinance or permit condition, or for good cause, and a permit holder whose permit is revoked gets no refund of fees paid. Any peace officer, park ranger or authorized city employee may issue a citation for a violation of chapter 17.
