Texas Pool Fencing Standards Set Statewide by HSC 757

Under HSC 757.003-757.004, a pool yard enclosure for a multi-unit residential pool must be at least 48 inches high, have no openings larger than four inches, and use gates that swing outward away from the pool with self-closing and self-latching hardware. The latch release must be at least 60 inches from the ground or shielded so a child cannot reach it. Vertical fence members must be no more than four inches apart, and horizontal members must either exceed 45 inches apart or face the pool side to prevent climbing. Single-family backyard pool fencing is governed by the locally adopted International Residential Code, which Texas municipalities cannot waive below state minimums for multi-unit properties.

Common violations include propped-open gates, broken self-closing hardware, fences below 48 inches, gaps wider than four inches, and climbable horizontal rails on the exterior. Violations can result in code enforcement action, lease termination remedies, and tort liability.
