Laguna Niguel, CA Trash & Recycling: Dumpster Rules (2026)

Section 9-1-45.19 implements the state Public Resources Code's recycling-space mandate locally, requiring recyclable-materials receptacles in addition to standard trash bins for any new multifamily project of five or more units, any new nonresidential project, and any existing multifamily or nonresidential project that expands by 30 percent or more in floor area, under subsection (b). Once a project needs an enclosure, subsection (d)(1) sets placement rules: every trash and recycling enclosure must sit within 250 feet of all the businesses or dwelling units it serves, must be located substantially away from public view and from pedestrian and vehicle circulation areas unless the decision-making authority finds that infeasible, and must be directly reachable by collection vehicles via alleys or driveways so haulers are not hand-carrying containers or pushing dumpsters long distances.

Subsection (d)(2) then sets construction standards: the enclosure sits on a concrete pad sized to the containers it holds per the disposal company's own standards, its walls run at least six feet high in materials and colors that match nearby buildings, and its doors are self-latching, metal or metal-framed, and heavy enough to withstand hard daily use, with interior curbs to keep dumpsters from damaging the enclosure walls. Recycling and trash plans for qualifying projects are reviewed together with the site development permit under § 9-1-114.1, and a recycling plan describing anticipated materials and volumes must be submitted under subsection (c).

Weather protection is also required under subsection (e): enclosures or containers holding recyclables that could be ruined by rain must be adequately protected, and subsection (f) requires every enclosure be maintained to control litter and odor, with regular collection.
