Full Breakdown
Coconut Creek does not let a contractor bring in its own dumpster or roll-off. Section 12-31(a) requires every person, owner, contractor, subcontractor, partnership or corporation doing work that needs a mechanical container for construction or demolition waste, solid waste or garbage to use the hauling service of the city's franchisee. The section separately makes it a violation for anyone other than the franchisee to haul or remove construction or demolition waste, rubbish, solid waste, recovered materials or garbage from any site in the city, with the same bar spelled out for sites in single-family or multifamily residentially zoned areas. Under subsection (c), the container itself must be a receptacle defined in the city's franchise agreement and obtained from the franchisee, and placing waste in any container or vehicle not obtained from the franchisee is a violation.
Site standards in subsection (b) require every construction or demolition site to be kept free of accumulated waste, with the site cleared on the same day work is done, unless the waste is properly contained in the franchisee's receptacles. Under subsection (d), a full container must be removed within forty-eight hours, except on Sundays. Subsection (e) allows exemptions for specific or unusual work only with written approval from the city, and the written exemption must be kept on site during that work.
Commercial dumpster storage is covered separately by section 12-27: commercial waste must be stored in containers or otherwise secured to eliminate wind-driven debris and unsightly litter, and the approved methods include containers, bins, and fenced or walled trash storage areas. Section 12-25(e) governs mechanical container systems, which must be designed to be hoisted mechanically without interference or delay, and city collection service is refused when a mechanized container is of a type or design the city has not approved. Section 12-25(f) bars any unenclosed container without city approval. Section 12-30(b) lets commercial properties that claim it necessary have daily collection except Sundays, and section 12-32 sets a minimum of three rubbish collections per week for restaurants and similar establishments handling waste foods.
Violations & Fines
Section 12-31 defines violations directly: using a hauler other than the city's franchisee, placing waste in a container or vehicle not obtained from the franchisee, and letting waste accumulate on a site outside the franchisee's receptacles. Section 12-37 sets a fine of up to $500.00 per day per violation after a guilty finding by a court of competent jurisdiction, and each day is a separate offense.
