Oakland caps amplified sound in city parks at 80 decibels measured at the park boundary, and no permitted loudspeaker may sit within 300 feet of a residential structure. Municipal Code § 12.64.120 sets the numeric ceiling for any permitted amplification system, including bandstands and portable audio.

Oakland bans operating any aircraft, a term the code defines to include helicopters, over the city with sound-amplifying equipment running. OMC § 8.18.100 makes it unlawful citywide to broadcast music, voice, or other noise from an airborne loudspeaker, though it doesn't reach ordinary flight or engine noise, which the FAA controls.

Leaf blowers are limited to daytime hours, must meet manufacturer noise ratings, and cannot exceed the residential decibel limits at neighboring property lines. Several Oakland neighborhoods have stricter HOA-level rules.

Operating amplified sound equipment outdoors, or indoors loud enough to reach the outdoors, anywhere in Oakland requires a written permit from the City Manager filed at least ten working days ahead. The City Manager must refuse a permit for use between 10:00 p.m. and 9:30 a.m., in residential zoning districts, or wherever it would disrupt business meetings or public hearings.

Oakland makes it an infraction to own, possess, or harbor a dog, cat, or bird that barks, howls, meows, or squawks continuously or incessantly for an unreasonable period, disturbing a neighbor across a property line. Oakland Municipal Code § 8.18.010(C)(4) folds this into the city's excessive-and-annoying-noise ordinance, with exemptions for animals provoked by a trespasser and a blanket carve-out for public zoos.

Oakland treats any accessory or device added to a vehicle that creates unnecessary noise as an excessive and annoying noise violation. Municipal Code § 8.18.010(C)(2) bars the attachment itself whenever it produces noise beyond what the vehicle needs, and violations are enforced as infractions through the same citywide nuisance procedure that covers barking dogs and alarms.

Oakland bars the loudest construction equipment on weekends and holidays. Municipal Code § 8.18.020(E) prohibits using pile drivers and jack hammers on Sundays and holidays, with only an exception for emergencies or work the Building Official has approved in advance: layered on top of the chapter's broader nine p.m. to seven a.m. nighttime noise nuisance rule.

Oakland allows extended home-share arrangements at a primary residence beyond the standard short-term rental cap when the host remains on-site overnight. This supports lower-cost lodging and homestay tourism without converting units to vacation use.

Any operator renting overnight lodging to guests for 30 days or less, including short-term rental hosts, must register with Oakland's Tax Administrator within 30 days of starting business and post a Transient Occupancy Registration Certificate under OMC § 4.24.060. The certificate authorizes tax collection only; it is not a business or land-use permit.

Oakland's STR ordinance (Chapter 5.96) requires hosts to disclose available on-site parking, advise guests of Residential Permit Parking (RPP) districts, and prohibit STR use of guest RPP permits. Properties in Oakland's Wildfire Prevention Assessment District and Very High Fire Hazard Severity Zone must maintain 100 feet of defensible space under California Public Resources Code §4291, including a 0–5 foot ember-resistant zone, 5–30 foot lean/clean/green zone, and 30–100 foot reduced-fuel zone. Oakland Fire Department conducts annual inspections of Hills parcels and issues correction notices with abatement deadlines.

Oakland's Fire Code amendments bar all open burning, including recreational fires and portable outdoor fireplaces, on red-flag days or any other day the Fire Code Official determines poses a high fire risk. The ban applies citywide and overrides the normal setback rules for that day.

Oakland's property-blight code bars parking, storing or keeping any regulated vehicle, trailer, boat or heavy equipment between a residential lot's front property line and the front wall of the house, unless it sits in an approved driveway or parking space. Municipal Code § 8.24.020(F)(6) makes an approved driveway the only lawful front-yard parking area.

Oakland residents can petition to create a Residential Permit Parking (RPP) area, but it takes signatures from 51% of addresses, at least six adjacent block fronts, 80% residentially zoned frontage, and proof that 75% of on-street spaces are already occupied during peak hours. The City Council must then approve the area by resolution under Chapter 10.44.

A red curb in Oakland means no stopping, standing or parking at any time, with the only exceptions being what the Vehicle Code itself allows and a bus stopping in a red zone that is also marked or signed as a bus zone. The rule comes from § 10.40.020(A)(1), which the Traffic Engineer applies when placing curb markings citywide.

Oakland Municipal Code § 10.28.260 bars parking any vehicle between 3:00 a.m. and 6:00 a.m. on streets the City Council has designated by resolution and posted with signs; violations carry a $32 fine under the parking fine schedule.

Oakland bans keeping a trailer, camper, RV, boat or other mobile equipment in a front or side yard of a residential lot for more than 72 consecutive hours under Municipal Code § 8.24.020(F)(2). Rear- or side-yard storage is allowed only inside an accessory building or with a 5-foot property-line setback, plus a usable open-space requirement.

Oakland bans parking any truck, tractor or trailer over 10,000 pounds GVWR on a public street in a residential district outright. Trucks between 7,000 and 10,000 pounds are banned only where the Traffic Engineer has posted restriction signs after finding a nuisance, blight or hazard, and trucks over 22 feet are barred from a defined downtown-adjacent zone unless a sign allows it.

Oakland's 2025 local amendments to the California Green Building Standards Code require multifamily projects to mark every EV-ready and EV-capable parking space and to document accessible EV charging spaces, and Oakland resolves any conflict with the state code in favor of whichever rule yields more EV charging capacity.

Abandoned vehicles subject to tow after 72 hours under OMC §10.64.170. Keeping wrecked, dismantled, or inoperative vehicles on private property for 72+ hours is a misdemeanor unless enclosed in a building.

Oakland marks curb loading zones with paint under Municipal Code Chapter 10.40. Yellow curbs bar all standing except loading or unloading between 7 a.m. and 6 p.m. daily, Sundays and holidays excepted: commercial deliveries get 30 minutes, passengers get 3 minutes. The Traffic Engineer can also post signed zones setting specific hours, and violators face fines under the city's parking fine schedule.

Oakland requires vehicles on one-way streets to park within 18 inches of the left-hand curb facing the direction of traffic, and bans standing on the left side of a one-way roadway unless signs permit it. Parking across a painted parking-space marking, wherever the Traffic Engineer has striped one, is also unlawful under § 10.28.040.

Oakland prohibits barbed wire, razor wire, and electrified wire on residential fences and walls under Planning Code § 17.108.140(B)(3). Chain-link is also capped at 42 inches in street-facing and near-front side yards, and bare concrete block fencing must be capped and finished with stucco or another approved material.

Oakland's Building Code amendment at § 15.04.2.214 sets the fence heights that stay building-permit-exempt: masonry or concrete fences up to 3 feet, and fences of other materials (except swimming-pool barriers) up to 7 feet. Anything taller, or any pool barrier, needs a building permit before it goes up.

Oakland caps retaining wall height at 8 feet under Planning Code Section 17.108.150, with narrow exceptions for driveway-flanking walls on steep lots and design-reviewed walls screened from view. Multiple walls must sit at least 4 feet apart, and any wall visible from the street needs a decorative finish.

Oakland exempts residential concrete or masonry fences up to 3 feet high, and fences of other materials up to 7 feet high, from a building permit under Municipal Code § 15.04.2.2505's local rewrite of California Residential Code § R105.2. Taller fences need a permit.

Oakland Municipal Code § 8.18.070 bans 'spite fences': any fence or fence-like structure erected or maintained maliciously to annoy an adjoining owner or occupant that unnecessarily exceeds six feet in height is an infraction and is deemed a private nuisance the neighbor can also pursue in civil court.

Oakland requires a City permit to open or run a pet shop, kennel, or animal hospital, and every animal on the premises must be kept clean and sanitary to the Animal Control Officer's satisfaction. The code does not ban retail sale of dogs or cats outright.

Oakland zones veterinary clinics under a distinct "Animal Care Commercial Activities" classification in Planning Code Section 17.10.510, separate from kennels and pet boarding. The defining limit: overnight care of animals is prohibited except when medically necessary, which is what separates a vet clinic from a boarding facility under the code.

Oakland Municipal Code § 6.04.400 limits any one premises to three dogs over four months old unless the owner shows the property has adequate space and the dogs don't create a nuisance. Licensed kennels, boarding facilities, vet hospitals, Oakland Animal Services, and approved foster homes are exempt from the cap.

Dogs in Oakland must be on a leash no longer than six feet on public property, with off-leash access limited to designated parks. Violations run $50 for a first offense up to $500 for a third within a year, plus possible misdemeanor charges after that.

Oakland requires every licensed dog to have a microchip implanted before Oakland Animal Services will issue or renew the license. A veterinarian must certify both the microchip and a current rabies vaccination as a condition of licensing.

Oakland does not license cats, but any cat over four months old that is permitted to roam off its owner's enclosed property must be spayed or neutered unless a vet certifies it cannot reproduce. Owners get 30 days to comply before fines apply.

Oakland bans trapping, snaring, capturing, or killing any wild bird within city limits, and separately bars anyone from throwing missiles at or disturbing waterfowl in or around Lake Merritt. Squirrels are protected from sale and import too.

Oakland doesn't regulate dogs by breed. Chapter 6.08 instead lets the City declare an individual dog "potentially dangerous" or "vicious" based on its documented behavior, after an administrative hearing. A vicious-dog finding triggers muzzling, a locked outdoor enclosure, $100,000 liability insurance, microchipping, and sterilization, all enforced with misdemeanor penalties.

Oakland Municipal Code § 6.04.355(A) makes it unlawful to harass any non-captive wild animal, coyotes, mountain lions, foxes, bobcats, raccoons and more are named specifically, by disrupting its breeding, feeding, or sheltering. The code carves out a hazing exception in § 6.04.355(C) for people legally engaged in hazing wildlife under applicable law, the tool the City's coexistence-based coyote program relies on instead of culling.

Oakland Municipal Code § 6.04.355(B) makes it unlawful to intentionally feed wild animals in any public park, sidewalk, street, or other City-owned property. "Wild" is defined broadly to cover pigeons, geese, and any animal that isn't a dog or cat, so the ban reaches routine park-bench bread-tossing as much as deliberate deer or coyote baiting.

Oakland caps residential livestock at three animals per property. Keep more than three cattle, sheep, swine, goats, equines, llamas or alpacas on one premises without a conditional use permit and Oakland Municipal Code Section 6.04.310(D) makes it a public nuisance, subject to citation, summary abatement and impoundment by Oakland Animal Services or the Oakland Police Department.

Oakland Municipal Code Chapter 12.36 (Protected Trees) requires a permit to remove or significantly prune protected trees, including all coast live oaks 4 inches or larger in diameter and any other tree 9 inches or larger measured 4.5 feet above grade.

California Civil Code 4735 prohibits HOAs from banning low-water or California-native landscaping, and Oakland's Bay-Friendly and creek-protection policies actively encourage native plants, though protected-tree rules under OMC 12.36 still apply to removals.

For properties registered under Oakland's Foreclosed and Defaulted Residential Property program, Municipal Code § 8.54.320 expressly counts artificial turf or sod "designed specifically for residential installation" as acceptable landscaping, but plain plastic sheeting or indoor-outdoor carpet does not qualify.

Under Chapter 8.24 (Property Blight), Oakland treats 'overgrown or dead or decayed trees, weeds or other vegetation' and 'rank growth' left uncleaned as blighted property. The Building Official enforces the chapter, can abate a violation under Chapter 15.08 procedures, and bills the owner; violating the chapter is an infraction under § 8.24.100.

Oakland enforces the state Water Efficient Landscaping Ordinance (WELO) through the building permit process. New landscapes of 500+ square feet and rehabilitated landscapes of 2,500+ square feet must meet state irrigation-efficiency and plant-water-use standards before a permit is approved.

Rainwater harvesting is legal and encouraged in Oakland under California AB 1750 (Rainwater Capture Act of 2012), which allows rooftop rainwater capture without a water rights permit, and EBMUD offers rebates for cisterns and rain barrels.

Removing a protected tree anywhere in Oakland, public or private property, requires a tree removal permit authorized by the city's Tree Reviewer before any building, grading, or demolition permit is approved. Permits run for one year, can be extended once for a second year, and carry a fee set by the city's master fee schedule.

Oakland treats a licensed Family Daycare Home caring for 14 or fewer children as a Permanent Residential Activity under Planning Code Section 17.10.110, not a commercial or civic use. That means it is allowed by right in residential zones, subject only to state licensing by the Department of Social Services.

Home-based businesses in Oakland can only see clients by appointment. Planning Code § 17.112.040(C) bars regular walk-in customers outright, and Subsection H caps the pedestrian and vehicular traffic a home occupation generates at roughly what an ordinary residence produces in that neighborhood.

Running a business from home in Oakland requires Director of City Planning certification under Planning Code Chapter 17.112. The rules apply citywide and confine a home occupation to the resident's living unit or an attached or detached garage, with no separate storefront, standalone office, or walk-in retail space allowed.

A home-based business in Oakland may post exactly one identifying sign, and it cannot exceed one square foot per face. Planning Code § 17.112.040(F) also bars any outside or window display of products and requires the sign to be nonmoving with indirect, nonflashing lighting only.

Oakland above-ground pools over 18 inches deep need the same permits, setbacks, and barrier rules as in-ground pools. The pool wall counts as the barrier only if 48+ inches high with removable or lockable ladders.

Oakland requires every property with a swimming pool to maintain a fence at least four feet high that completely encloses the pool, per Oakland Municipal Code § 8.36.010. Gates in that enclosure must have a self-closing or self-latching device, and the Building Inspector can approve alternative designs through a written application and appeal process.

Oakland's Planning Code does not require an owner to live on site for a standard Accessory Dwelling Unit, but it does for a Junior ADU. Under Section 17.09.040, the owner must occupy either the JADU or the primary home, and record a deed restriction confirming it.

Oakland exempts Accessory Dwelling Units from its Affordable Housing Impact Fee entirely. Municipal Code § 15.72.040(C)(1) lists ADUs, as defined in Planning Code § 17.09.040, among the project types excused from paying the citywide per-square-foot development fee.

A carport or attached garage next to an Oakland house must carry its own residential fire sprinklers under Municipal Code § 15.12.030, amending California Fire Code § 903.2.18. The system has to meet CRC § R313 or NFPA 13-D, deliver at least .05 gallons per minute per square foot, and treat the garage door as open space rather than an obstruction.

Owners of accessory dwelling units built before January 1, 2020 can apply to delay code enforcement for up to five years under Oakland Municipal Code Article XIV, provided the violations don't threaten health or safety. The Building Official decides case by case, and the program sunsets January 1, 2030.

Oakland Municipal Code § 15.08.750 makes it a public nuisance to rent out an accessory dwelling unit for less than 30 days. There's no permit path around it: the ordinance flatly prohibits offering an ADU as a short-term rental, and violations trigger the City's civil-penalty enforcement chapter.

Oakland garage conversions are processed as ADUs under Gov Code §65852.2, which bars replacement parking demands. Permits cover structural, electrical, plumbing, and Title 24 upgrades to meet CRC habitability.

Oakland's Fire Code keeps barbecues, fire-pits and other open flames at least 10 feet from combustible construction or decorative material under Municipal Code § 15.12.030, amending California Fire Code § 308.1.4. Open-flame cooking devices get a narrower clearance: 10 feet from vegetation instead of structures, the same distance required for approved heaters at one- and two-family homes.

Oakland's Fire Code amendments keep open flames, including barbecues, fire pits, gas heaters, and candles, at least 10 feet from combustible construction and away from decorative or combustible materials. Open-flame cooking devices get a narrower exception if kept 10 feet from vegetation.

Oakland declared a climate emergency in 2018 and adopted the 2030 Equitable Climate Action Plan (ECAP) targeting 56 percent emissions reduction by 2030 and net-zero by 2045, focusing on transportation, buildings, and Port of Oakland decarbonization.

Building, extending or repairing any pier, slip, wharf, dock or other harbor structure inside Oakland's designated Port Area requires a building permit from the Board of Port Commissioners, or from the Executive Director for privately owned property, under City Charter § 708.

Oakland Municipal Code § 8.18.020(B) makes unnecessary idling of internal combustion engines a public nuisance, one of five construction-noise controls tied to the city's 9 p.m.-to-7 a.m. persistent-noise rule. The Health Officer can order written abatement, and failure to stop within 48 hours turns the idling into a chargeable infraction under § 1.28.020.

Inside Oakland's D-DT Sea Level Rise Combining Zone, Planning Code Section 17.101K.180 requires new principal buildings to submit a Sea Level Rise Adaptation Plan and raise the bottom story's finished floor at least twelve inches above the projected future inundation level, subject to the Director of Planning's approval.

Properties in Oakland Hills Very High Fire Hazard Severity Zone must maintain 100 feet of defensible space, clearing brush, trimming trees, and removing combustible debris under PRC 4291 and Oakland Fire Code amendments after the 1991 firestorm.

Oakland bans non-storm-water discharges into its storm sewer system and prohibits illicit drainage connections to storm drains or watercourses under Municipal Code Chapter 13.16. Violations are infractions carrying escalating fines and, after repeated offenses, misdemeanor charges.

Oakland will not issue a grading permit for a site in a designated Flood Hazard Area unless the grading plan includes flood mitigation measures approved by the Building Official. Applicants must disclose flood-zone location on the permit application, and buildings in flood hazard areas need an elevation certification before vertical construction proceeds.

Oakland requires a grading permit from the City Engineer or Building Official before any excavation or fill exceeding fifty cubic yards on a slope over 20%, any work totaling more than five hundred cubic yards, or land disturbance over an acre, under Chapter 18B of the Building Code amendments. Cannabis home cultivation is legal in Oakland for adults 21+ under California Proposition 64. Up to 6 plants per household may be grown. Oakland has been at the forefront of cannabis equity, including its Cannabis Equity Program supporting social equity applicants.

Oakland's Bureau of Building must run an administrative, nondiscretionary review for small residential rooftop solar systems and issue a same-day permit for complete over-the-counter applications, or approve electronic applications within one to three business days, under Municipal Code Chapter 15.33.

Before Oakland's Bureau of Building will process a rooftop solar application, it must be built against the City's standard plan and checklist under OMC § 15.33.080, and the system itself must meet PG&E interconnection, listing-agency and California Electrical Code standards under § 15.33.070.

Oakland bans any sign designed primarily to be viewed from a freeway under Municipal Code Chapter 15, Sec. 1501, with narrow exceptions for on-site business-name signs, product-name signs, small six-square-foot lease signs, and time-and-temperature displays. The Building Official, City Traffic Engineer, and Director of City Planning jointly decide whether a proposed sign violates the ban, and denials can be appealed to the City Council.

In Oakland's RU-4, RU-5, and all Commercial and Industrial Zones, a window sign cannot cover more than 25% of any single window under Planning Code § 17.104.020(K). Signs count toward the property's aggregate sign area cap, but interior signs set back 18 inches or more behind the glass are exempt from the limit entirely.

Oakland's Property Blight Ordinance bans letting real property fall into any of eleven defined blighted conditions, from abandoned structures to inadequately maintained landscaping, and lets the Building Official abate violations, restrict occupancy of dangerous properties, and recover the city's costs from the owner.

Oakland treats any vacant or unimproved lot with overgrown weeds, dead vegetation, rubbish or accumulated debris as a "blighted property" under Municipal Code § 8.24.020(D)(1). The Building Official enforces the standard citywide, can order abatement under § 8.24.060, and every day the condition continues is a separate infraction under § 8.24.100.

Oakland's Planning Code bars commercial and industrial activities near residential zones from producing glare perceptible without instruments at the lot line or, for certain zones within 400 feet, at the residential zone boundary. Violations run through the Planning Code's infraction and public-nuisance enforcement track.

Oakland's Just Cause for Eviction Ordinance, Measure EE, bars a landlord from terminating a tenancy or recovering possession of most rental units unless the landlord can prove one of eleven specific grounds, from unpaid rent to an owner's good-faith move-in. Municipal Code Section 8.22.360 puts the burden of proving a qualifying ground on the landlord in every case.

Oakland's Building Maintenance Code requires every rental dwelling unit to have a working bathroom, a kitchen with sink and cooking appliance, and heat capable of holding 68°F. The Building Official enforces these standards under O.M.C. Chapter 15.08, with violations treated as public nuisances subject to repair orders or vacation.

Oakland's Just Cause for Eviction Ordinance, enacted in 1980 as the first such ordinance in the United States, recognizes a closed list of no-fault grounds including owner move-in, Ellis Act withdrawal, substantial repairs, and condo conversion.

Oakland requires all rental property owners to pay the Rent Adjustment Program fee and register with the city. The fee funds the Rent Adjustment Program which administers rent control and just-cause eviction protections.

Municipal Code § 8.28.100 declares noncompliance a public nuisance, and § 8.28.141(a) locks single-family generators into weekly compost-cart service.

Grass clippings, leaves, tree trimmings and other "green material, landscape and pruning waste" are legally "Organic Waste" under Oakland Municipal Code § 8.28.010, and every generator must place it in the City's compost container for weekly collection. Section 8.28.141(b) bars mixing yard debris into the mixed-material or recycling cart.

Oakland owners must have solid waste, recyclables, and organics collected at least once a week by the City's contracted hauler or hauled under a Director-issued self-haul permit. Skipping the weekly minimum is declared a public nuisance under Municipal Code Chapter 8.28, on top of infraction fines.

Oakland requires solid waste, recyclables and organics to be collected, or self-hauled under a permit, at least once a week from every premises. Municipal Code § 8.28.120 sets that weekly minimum and lets the City require more frequent service if a property generates more waste than its containers can hold between pickups.

Any commercial premises in Oakland must provide enough City-approved containers, bins, carts, or roll-off boxes and compactors sized for the business, to hold all trash, recycling and organics generated between pickups. Municipal Code § 8.28.140(A) requires those containers to be watertight with a tight-fitting cover, and § 8.28.010 defines "Container" broadly enough to reach roll-off boxes and compactors.

Oakland gives its franchised hauler, the MM&O collector, the exclusive right to collect bulky goods, old appliances, furniture, mattresses, carpets and large plant debris, from any premises. Municipal Code § 8.28.060 makes it unlawful for anyone else to haul bulky items away, with narrow carve-outs for City crews, self-haulers with a permit, and nominal-charge retailers.

Oakland requires single-family households on curbside collection to set mixed-material, recycling, and compost carts at the curb only on their assigned pickup day, clear of driveways, sidewalks, and the street. Once the City's contracted collector empties them, carts must go back to their normal storage spot promptly. The rule sits in Municipal Code § 8.28.141(a), backed by escalating infraction fines under § 8.28.290.

Oakland allows mobile food and retail vending carts on publicly owned property and in the right-of-way throughout any commercial or industrial zoning district, and lets roaming sidewalk vendors work any zoning district citywide. Municipal Code § 8.62.090 sets buffer distances between vendors and bars carts from blocking driveways, bike racks, crosswalks, emergency routes, building entrances, accessible routes or trash enclosures.

Oakland lets food trucks vend from a parking lane at multiple stops as long as they keep a 300-foot buffer from another vendor or restaurant, waivable in writing, under Municipal Code § 8.62.090(B). Trucks must also stay 300 feet from any K-12 school during school hours unless selling City-defined 'healthy foods' with the school's written permission.

Oakland Municipal Code Section 8.62.090 fixes exact mobile-vending buffers: a food truck parked in a travel lane must hold a 300-foot buffer from another vendor or restaurant, a sidewalk vendor needs only 100 feet, and every vendor must clear 300 feet from a K-12 school between 7 a.m. and 6 p.m. on school days unless it sells only "healthy foods."

Oakland's Parks and Recreation Commission sets each park's open hours, and it is illegal to enter or stay in any city park once it has closed. Municipal Code § 12.64.110 backs the after-dark closures posted at Lake Merritt, Joaquin Miller and every other city park.

Oakland's City Council can establish a street setback line by ordinance after a petition, published notice and hearing; once effective, it is unlawful to build any structure between the street line and the setback line, and building within that space is an infraction under Municipal Code Chapter 15.48.

In Oakland's RH Hillside Residential Zones, maximum lot coverage scales down as lot size goes up. Planning Code Table 17.13.04 sets coverage at 40% for lots under 12,000 square feet, dropping to 30%, 20% and 15% on the largest lots, under Section 17.13.050(B).

Oakland protects Coast Live Oaks four inches or more in trunk diameter and every other tree species nine inches or larger, with narrow exceptions for Eucalyptus and Monterey Pine. Removing a covered tree anywhere in the city, on private or public land, requires a tree removal permit under Municipal Code Chapter 12.36.

Anyone who plants, removes, or otherwise alters a tree or shrub along an Oakland public street needs a written permit from the Director of Parks and Recreation. The City Manager holds full authority over street tree work citywide under Municipal Code Chapter 12.32, and any permit issued expires 60 days after the date it's granted unless the work is finished.

Oakland's Housing Code requires every smoke and carbon monoxide alarm installed in a residential building to have captive screws or another tamper-resistant method preventing removal, and to be kept in proper working order. A unit missing a required smoke or CO alarm altogether can be declared substandard and a public nuisance.

Oakland Municipal Code § 8.04.090 sets exact locking-hardware specs for the rear, side and basement doors of commercial buildings, dead locks, reinforced glass panels, and sixteen-gauge steel backing on hollow doors, enforced by the Chief of Police with mandatory correction notices for noncompliant businesses.

Oakland requires five staged Major Inspections under Municipal Code § 15.04.2.256, Preconstruction, Foundation, Slab or Under-Floor, Frame, and Final, each contingent on Best Management Practices, required certifications and fees, and City or outside-agency approvals before work can proceed to the next stage.

Oakland requires a separate electrical permit or a combination permit from the Building Official before any electrical system or equipment covered by the California Electrical Code is installed, altered, repaired, replaced or remodeled. Exemptions from permit requirements never authorize work that otherwise violates the Code, per Municipal Code § 15.04.2.350.

Oakland makes it unlawful to alter, repair or install a plumbing system without complying with the Municipal Code's permit provisions, and its Amendments rename the state Uniform Plumbing Code the "Oakland Amendments of the California Plumbing Code." Permit holders must keep qualified personnel on site and pay Master Fee Schedule investigation and re-inspection fees.

Oakland requires private development to meet green building standards under OMC Chapter 18.02, with compliance verified by a certified Green Building Certifier and enforced as a condition of the building permit. Projects that fail to certify go straight to Code Enforcement.

Oakland makes property owners solely responsible for removing lead hazards in dwellings, and a certified Lead Risk Assessor's report, not the owner's judgment, decides what removal or control is required; refusing an abatement order is a misdemeanor.

Every Group R building in Oakland, from single-family houses to apartments, needs an automatic sprinkler system under Municipal Code § 15.12.030, amending California Fire Code § 903.2.8. For Group R-3 houses and duplexes, § 903.3.1.3.1 goes further, requiring a modified NFPA 13D system that covers garages, carports, bathrooms, closets, attics, laundry rooms and enclosed stair landings up to 12,000 square feet.

Oakland Municipal Code § 15.04.1.130 makes it unlawful to erect, alter, repair, move, convert, or demolish any building, structure, or plumbing, mechanical, or electrical system in violation of the Building Construction Code, meaning covered work needs an approved City permit unless it falls within a narrow exemption list.

Oakland Municipal Code Chapter 8.72 requires operators of buildings with three or more residential units and an elevator to keep it in good working order, complete repairs within 24 hours of notice, and cover alternative housing (capped at $250/night) for residents whose disability or medical condition leaves them unable to use the stairs while the elevator is down.

Oakland requires a special event permit before any street fair, festival or gathering of 50 or more people at a public park or facility can go forward. Municipal Code Chapter 9.52 puts the City Administrator in charge of approvals, sorts events into four tiers by size and risk, and sets separate advance-filing deadlines, from 21 days for a small Tier One fair up to 120 days for a Tier Four event.

Any private gathering of 25 or more people, or any public special event, in an Oakland park needs a permit from PRCS Central Reservations under Municipal Code §§ 12.64.250-12.64.330. Special events additionally require a Police Department permit under Chapter 9.52.

Oakland treats a block party as a short term right-of-way encroachment: a resident representing a majority of the block can get a permit from the City Administrator good for up to three days, plus prepaid police traffic-control costs.

An Oakland parklet lets a restaurant or café convert up to two on-street parking spaces into dining space under a revocable permit issued through the same § 8.62.050 process used for sidewalk permits. Municipal Code § 8.62.010 caps a parklet at two spaces in front of the business, and § 8.62.160 lets the City Administrator set separate parklet design guidelines operators must follow.

Anyone who wants to hold a parade in Oakland must get a permit from the Chief of Police before the event, under Municipal Code Section 12.44.060. The only exemptions are parades and special events confined entirely to a city park under Parks and Recreation's jurisdiction, and funeral processions.

Oakland restaurants, retailers and cafés must get a revocable sidewalk dining, retail or café permit from the Department of Transportation before placing tables, chairs or display racks in the public right-of-way. Municipal Code § 8.62.050 sets the application, insurance, inspection and design requirements, including a mandatory six-foot pedestrian clearance and a ban on amplified music in the dining area.

Any minor encroachment into Oakland's public right-of-way, from planter boxes to bus shelters, needs a permit from the Director of Transportation, who can require a performance bond and site-specific conditions before approving it.

Placing goods, wares or merchandise on an Oakland sidewalk is unlawful except brief loading and unloading, capped at one-third of the sidewalk's width for no more than 30 minutes, with narrow exceptions for newspaper racks and sidewalk cafes.

Abutting property owners, tenants or occupants must repair a dangerous sidewalk once the Director of Public Works serves written notice, and have only three days to start the work before it becomes a Code violation.

Oakland bars and nightclubs that sell alcohol keep their Deemed Approved land-use status only if they avoid excessive loud noise, especially late at night or early morning. A noise complaint can trigger a public hearing that adds conditions or revokes the establishment's right to operate.

Oakland caps the exterior noise from a residential air conditioner or refrigeration unit at 50 dBA under Planning Code Section 17.120.050(H), rising to 55 dBA for equipment installed before the standard took effect. Commercial refrigeration units face the same enclosure and distance rules: a mobile unit cannot sit within 200 feet of a residential zone between 10 p.m. and 7 a.m. unless enclosed to cut noise to 60 dBA or less.

Oakland bars noisy loading and unloading overnight. Municipal Code § 8.18.010(C)(8) makes it excessive and annoying noise to load, unload, open, close, or otherwise handle boxes, crates, containers, building materials, or refuse between nine p.m. and six a.m. in a way that disturbs a residential neighbor across the property line: the window that covers early-morning delivery trucks and trash pickups.

Oakland gives car alarms a hard fifteen-minute limit. Municipal Code § 8.18.010(C)(7) makes it an excessive-and-annoying-noise violation to let any exterior burglar or fire alarm, including a motor vehicle burglar alarm, keep sounding for more than fifteen minutes after it activates, and the same clock applies to alarms on buildings, not just cars.

A tenant who believes an Oakland rent increase is improper, or that the owner cut housing services or skipped a required notice, can file a Rent Adjustment Program petition under § 8.22.090, generally within 180 days of the rent increase notice, triggering a mandatory 30-day owner response.

Owners of formerly foreclosed, non-owner-occupied 1-to-4-unit properties must register with Oakland within 90 days of acquisition and schedule a City inspection within 30 days of registering, under the Non-Owner Occupied Residential Building Registration program at Municipal Code Chapter 8.58.

Oakland Municipal Code § 8.18.060 makes it an infraction to let Scotch or Canada thistle, Russian thistle, Mexican cocklebur, or 'any noxious weed' go to seed on land you own or control, or to sell, transport, or otherwise disseminate the seed of those plants within the city.

Oakland treats automated license plate readers as regulated "surveillance technology," so police cannot buy, deploy or expand ALPR use without City Council sign-off under Municipal Code Chapter 9.64. Every ALPR program needs Privacy Advisory Commission review, a public surveillance use policy, and an annual surveillance report before and after the Council approves it.

Oakland Municipal Code § 9.08.270 states that photographing, audio recording or videotaping a police or peace officer in a public place, or from a place the recorder has a right to be, does not by itself violate any law or create reasonable suspicion or probable cause to detain or arrest that person.

Oakland outright bans its own government, including police, from acquiring, retaining, requesting or using facial recognition and other "Biometric Surveillance Technology," plus predictive-policing algorithms, under Municipal Code Section 9.64.045. Unlike other surveillance tools, no City Council vote can authorize an exception to this prohibition.

Oakland voters adopted Measure FF in 2014, setting a $12.25 minimum wage starting March 2015 with annual CPI indexing. Wages exceed the California state minimum and apply to all employees working at least two hours per week in Oakland.

Measure FF also created Oakland Earned Sick Leave under OMC 5.92, requiring all employers to provide one hour of paid sick leave per 30 hours worked, capped at 40 or 72 hours depending on employer size, available for employee or family illness.

Oakland has no separate right-to-farm nuisance-protection ordinance; instead its Planning Code classifies on-site agriculture as its own use type. Section 17.10.590 defines Agricultural and Extractive Activities, and Section 17.10.610 caps Limited Agricultural Activities at three livestock animals and three beehives per lot.

Oakland bars the city from signing, renewing, or amending contracts with any vendor that supplies ICE, CBP, or HHS's Office of Refugee Resettlement with data-broker, extreme-vetting, or immigration-detention-facility services, and bars city investment in those companies. Waivers require a written finding that no compliant alternative exists, under Municipal Code Chapter 2.23, the Sanctuary City Contracting and Investment Ordinance.

Oakland does not require private employers to use the federal E-Verify system. California Labor Code section 2814 limits employer use of E-Verify beyond federal mandates, and Oakland sanctuary policy bars city departments from compelling immigration verification beyond federal I-9 requirements.

Oakland Municipal Code § 9.08.160 makes it unlawful to sit, lie or sleep on any public highway, alley, sidewalk, crosswalk or other place open for pedestrian travel, with a narrow exception for people who cannot stand due to physical disability.

Oakland's Measure W vacant property tax fund pays directly for sanitation, bathroom, and cleaning services at homeless encampments. Municipal Code Section 4.56.050 lists this among the required uses of the tax, and Section 4.56.060 creates a Commission on Homelessness that oversees how the money is spent and reports annually on the results.

Stopping or parking in an Oakland bike lane draws a $105 local fine under the City's own parking fine schedule for a California Vehicle Code Section 21211(b) violation. Motorized scooters, meanwhile, are restricted under Municipal Code Section 10.17.020 to streets with a 25 mph posted limit and any Class II bike lane where one exists.

Oakland Department of Transportation (OakDOT) permits a small number of shared e-scooter and e-bike operators under fleet caps, equity zone deployment, no-sidewalk-riding, and locked-to-rack parking rules to limit clutter on sidewalks.

Oakland Planning Code Section 17.120.050 sets noise limits by the receiving property's zone. A data center's cooling and generators may not exceed 60 dBA daytime and 45 dBA nighttime at a home, 65 dBA at commercial property, or 70 dBA at industrial property.

Oakland has no dedicated data-center ordinance and no "data center" use classification. A data center is treated as a Light or General Manufacturing industrial activity, permitted by right in the CIX, IG, and IO industrial zones under Planning Code Chapter 17.73.

Oakland's Advisory Agency must deny a tentative subdivision map in an EBMUD-designated water reuse area unless the design provides a separate plumbing system for recycled water in common areas, per Municipal Code § 16.08.030(I).

New buildings in Oakland's ten D-DT Downtown District zones must follow General Design Standards under Planning Code § 17.101K.130: a recessed, street-facing ground-floor entrance, durable materials, an active-use zone at the sidewalk, and tower massing breaks on taller buildings.

California Government Code 65915 lets Oakland developers add up to 50 percent more units, fewer parking spaces, and request waivers in exchange for setting aside affordable units; Oakland applies this on top of Title 17 form districts.

Oakland requires every owner or occupant of a wharf, building, or basement to rat-proof it with screens, netting, or cement, and to use traps or other eradication methods the Health Officer directs, under Municipal Code § 8.38.180.

Oakland food workers must hold a California Food Handler Card within 30 days of hire, and each food facility must employ a Certified Food Protection Manager under CalCode.

OMC Chapter 2.28 requires city contractors, lessees of city property, and recipients of large city financial aid, including hotels at the Oakland Airport and Coliseum complex, to pay employees a living wage indexed annually for inflation.

Oakland charges a combined 14 percent transient occupancy tax on any hotel stay of 30 days or less: 11 percent under OMC § 4.24.030 plus a 3 percent surcharge under § 4.24.031 that funds the Convention and Visitors Bureau, the Zoo, the Museum, Chabot Space and Science Center, and Cultural Arts programs. The broad "hotel" definition reaches short-term rentals too.

Oakland's City Council designates landmarks by ordinance under Planning Code Section 17.136.070 for facilities with special historic, architectural or cultural value. Once a site is designated, exterior construction or alteration needs Design Review approval, and the owner must keep the landmark's exterior in good repair or face zoning enforcement.

Oakland bars Adult Entertainment Activities from opening anywhere in the city without a Conditional Use Permit, and zoning locks in strict spacing on top of that: no adult business may sit within 1,000 feet of a Residential Zone boundary or within 300 feet of another adult entertainment use.

Oakland pedestrians must cross at right angles to the curb or take the shortest route to the opposite curb outside marked crosswalks, under Municipal Code Section 10.24.030. Crosswalks themselves are set only where the City Traffic Engineer finds a particular pedestrian hazard, and never in a block shorter than 400 feet unless at an intersection.

Oakland bans drinking any alcoholic beverage on public streets, sidewalks, alleys, highways, city parks, recreation areas, open space or playgrounds, and within 50 feet of those areas on private property visible from public view without the owner's permission. Municipal Code § 9.08.180 sets no listed penalty of its own, so violations default to Chapter 1.28's misdemeanor punishment: up to six months in county jail or a $1,000 fine.

Oakland bans smoking and vaping in unenclosed service areas, dining areas, and recreational areas like parks and playgrounds, and in multi-housing common outdoor areas unless the landlord sets up a narrowly bounded designated smoking zone under Municipal Code § 8.30.055.

Oakland bans skateboards, roller skates and coasters from every roadway and crosswalk citywide, and from sidewalks specifically within business districts, under Municipal Code Section 10.16.160. Motorized skateboards face an even tighter rule: barred from every sidewalk and roadway in the city, business district or not.

Oakland Municipal Code Section 9.08.170 makes it unlawful to loiter or stand on any public highway, alley, sidewalk, crosswalk or other pedestrian way in a manner that blocks or unreasonably interferes with the free passage of pedestrians, or that blocks the entrance to a church, hall, theater or other place of public assembly.

Oakland taxes vacant parcels $3,000 to $6,000 a year under the Vacant Property Tax Act. A parcel counts as vacant if it is in use fewer than 50 days in a calendar year, and the tax is collected on the county property tax bill unless the City Council chooses another method.

Oakland taxes every parking-space rental in a parking station at a combined 18.5 percent: a 10 percent base tax under OMC § 4.16.030 plus an 8.5 percent surcharge under § 4.16.031. Operators collect the tax from occupants and remit it to the Tax Administrator; city-owned coin parking meters are the only exemption.

Oakland Municipal Code § 9.24.040 bars anyone, including a social club, from conducting or participating in a card game in a public place or one charging admission without first getting a permit from the Chief of Police, who must act within seven days.
