Local Rules Near UC Irvine

Irvine is phasing out gas-powered landscaping equipment entirely under Municipal Code § 6-8-205(D). Large businesses (50+ employees) lost gas leaf blowers and mowers on July 1, 2024; every other business and resident followed on January 1, 2025. Gas string trimmers, hedge trimmers, chain saws, and edgers follow the same two-tier schedule, ending July 1, 2026 for everyone else.

Irvine's noise chapter does not reach helicopter or airplane noise. Municipal Code § 6-8-205(E)(4) exempts any activity or equipment whose noise design is preempted by state or federal law, and the Code's own note names aircraft in flight -- along with motor vehicles and railroads -- as the preempted category. Federal aviation rules, not the City, govern helicopters overhead.

Irvine restricts construction-related noise, including equipment operation and material deliveries, to Monday-Friday 7 a.m.-7 p.m. and Saturday 9 a.m.-6 p.m. under City Code § 6-8-205(A). Work is barred entirely on Sundays and federal holidays except Columbus Day. Contractors who need to run equipment outside these windows must obtain a temporary waiver from the Chief Building Official before starting.

Irvine defines a "barking dog" as one that makes noise audible off the property for 30+ minutes of incessant barking or 60+ minutes of intermittent barking in 24 hours, then runs a civil-citation and fine system under Government Code § 53069.4.

Irvine bans public address systems and amplified sound in city parks except in areas the Community and Library Services Department has specifically designated, and even there a written PA permit is required. Anyone staging a concert, bandstand act, or similar outdoor performance in a public place must also get a separate entertainment permit from the Director first.

Irvine bans short-term rentals outright in every residential zone under Zoning Ordinance Sec. 3-25-3, so any stay under 31 days is automatically unlawful. Because there's no legal STR to renew, the code instead punishes repeat operators through an escalating fine ladder: $1,500 for a first infraction, $3,000 for a second within a year, and up to $5,000 for each further violation.

Irvine bars hosting platforms, not just hosts, from short-term rental transactions. Zoning Ordinance § 3-25-7(A) prohibits any platform from completing a short-term rental booking in the City, and § 3-25-7(C) bars it from collecting any fee, monetary or not, for facilitating one, including ancillary services like cleaning, catering or property management tied to the stay.

Irvine issues no short-term rental permits because the use itself is banned. Zoning Ordinance § 3-25-1 declares short-term rentals a prohibited use in every residential zoning district, and § 3-25-3 makes it unlawful for a 'responsible party' to operate one or to advertise a stay of less than 31 consecutive days. There is no permit path: the prohibition is absolute.

Irvine regulates propane and LP-gas storage entirely through the 2025 California Fire Code, which the City adopts in full. Sec. 5-9-409 confirms 'Chapter 61 Liquefied Petroleum Gases is adopted in its entirety' with no local amendment. The Orange County Fire Authority enforces the state's container separation, clearance and quantity standards, and Irvine backs them with its own penalty and misdemeanor provisions.

Wood-burning fire pits, rings, and outdoor fireplaces at Irvine homes must sit in a contained firebox with a spark arrester, and wood fires can't burn within 25 feet of a combustible structure unless inside an approved permanent fireplace. A Fire Code amendment sets narrower setbacks for portable, spark-arrested devices.

Irvine's fire code official can order flammable vegetation cleared for 10 feet on each side of any street or private road used for vehicular traffic. The rule exempts single ornamental trees, shrubs, and cultivated ground covers like ivy or succulents that don't readily carry fire.

Inside Irvine's Wildfire Risk Areas and adjacent brush or grass-covered land, welding, cutting torches, tar pots, and other spark-producing equipment can't be used without first clearing a 30-foot flammable-material buffer, keeping fire tools on hand, and stopping work when winds exceed 8 mph in low humidity.

Irvine bans keeping, storing or selling any fireworks that violate the City Code, and the Fire Chief or Public Safety Director can seize violating stock at the owner's expense. Public displays are allowed only under an Orange County Fire Authority-reviewed permit that requires electrical firing and a shell-based fallout diagram.

Irvine bans outdoor wood and solid-fuel fires whenever sustained winds top 8 mph with humidity under 25%, a red flag warning is declared, or the fire code official posts a burn restriction. All outdoor fires, regardless of fuel, are barred once sustained winds exceed 20 mph, under a Fire Code amendment enforced by the Orange County Fire Authority.

Irvine standardizes curb color citywide under Municipal Code Section 6-3-504: yellow for loading zones, red for bus stops and no-parking areas, white for passenger loading, and green for time-limited parking. The Director of Public Works must apply that exact color code, or, where there is no curb, post a matching sign, before any zone restriction applies.

Irvine designates commercial loading zones by City Council resolution under Municipal Code § 6-3-503, and the Director of Public Works marks each zone with a yellow-painted curb, or a posted sign where no curb exists, under § 6-3-504. Passenger loading zones get a white curb instead. Businesses that need dedicated truck-loading space on a public street must petition the City rather than paint or post their own signage.

Irvine lets residents petition the Director of Public Works to designate a preferential parking district when on-street parking is squeezed and other fixes have failed. Each dwelling unit can hold up to three resident permits plus two guest passes, valid two years, with a Police Chief review process for denials and revocations.

Irvine confines residential vehicle parking within any setback area to approved drives, parking areas, garages and carports. Zoning Ordinance Sec. 3-34-1.A bars parking or storing any vehicle in a setback area outside those improved surfaces. That rules out parking on bare dirt, gravel pads, or a front-yard lawn area cut into the setback, regardless of vehicle type.

Irvine bans overnight trailer coach and camp car parking on any public street citywide. Municipal Code Section 6-3-576 makes it unlawful to camp overnight or park a trailer coach or camp car overnight on any public highway, including the right-of-way, so RVs and similar trailers cannot be left on a public street overnight regardless of duration.

Irvine bars any commercial vehicle rated 6,000 pounds gross vehicle weight or more, box trucks, tractors, work rigs, from parking or being stored anywhere on residential-zoned property under Zoning Ordinance Sec. 3-34-1.A. The rule exempts campers and motor homes, and allows brief stops to load or unload goods or deliver construction materials to a permitted job site.

Irvine makes it a public nuisance, and a misdemeanor, to keep an abandoned, wrecked, dismantled or inoperative vehicle in public view on private or public property for more than 10 days, under Sec. 4-11-202 and 4-11-219. The Director of Public Safety can order removal after a 10-day mailed notice, with a right to a hearing and appeal.

No vehicle, trailer, or large equipment may sit on an Irvine public street for more than 72 consecutive hours under Municipal Code Section 6-3-574. The cap covers cars, trucks, tractors, farm or special-purpose machinery, and trash bins left at the curb, with trailer coaches carved out for the separate overnight-camping ban in Section 6-3-576.

Irvine's Expedited Permitting Process for Electric Vehicle Charging Stations Ordinance requires the Building Official to administratively approve a complete EVCS application through electronic submittal unless it poses a specific, adverse impact on public health or safety: with a 15-day appeal window to the Planning Commission.

Irvine regulates how vehicles sit within marked on-street parking stalls under Municipal Code Section 6-3-582. A vehicle must fit wholly inside a single marked stall, park facing the same direction as roadway travel in a parallel stall, and pull within 12 inches of the curb in a diagonal stall: rules aimed at keeping right-of-way parking orderly.

Irvine requires a building permit for any wall or fence over seven feet tall, and for community pool security fencing of any height, under Zoning Ordinance Sec. 3-35-2.B.3. Shorter fences built to the code's height table generally do not need one.

Shared fences between neighbors in Irvine are subject to California Civil Code Section 841 (Good Neighbor Fence Act) for cost-sharing and the Irvine Zoning Ordinance for height and material requirements.

Irvine caps residential front-yard fences at 2.5 feet, rising to 7 feet with setback, and limits corner-lot sight triangles to 2.5 feet under Zoning Ordinance Sec. 3-35-2. Rear and side fencing in most zones tops out at 7 feet, and any fence over 7 feet needs a building permit.

Irvine's Zoning Ordinance flatly bans seven fencing materials citywide, barbed wire, wire, electrically charged fencing, plain exposed concrete block, plastic, chain link and grape stakes, under Sec. 3-35-2.C.2. Narrow exceptions exist for chain link in agricultural, industrial and construction-site settings, but the base rule is a straight materials ban, not a design preference.

When a retaining wall is combined with a fence or wall on an Irvine property, the combined structure can reach up to 10 feet above grade along a streetside property line, or 12 feet along a rear property line. Zoning Ordinance Sec. 3-35-2.B.1. Anything over seven feet still needs a building permit under the same chapter's permit trigger.

Keeping an equine, bovine, swine, sheep or goat inside Irvine requires a livestock permit from the Director of Public Safety, and the property must also sit in a zone that expressly allows livestock under the Zoning Code: the two requirements stack.

Unlike dogs, cats in Irvine are never required to wear a City license tag: Sec. 4-5-211 makes cat registration optional, though any cat that is registered must carry a current one-year rabies certificate. Loose cats aren't covered by the leash law, but owners are still on the hook for trespass, damage, and excreta nuisances under the general animal code.

Irvine bans commercial pet stores from selling dogs or cats at all. Sec. 4-5-506 prohibits any commercial establishment from displaying, selling, delivering, bartering, or otherwise transferring a dog or cat in the city, allowing only nonprofit rescue and shelter adoption placements instead.

Irvine's zoning ordinance sorts veterinary uses into two very different categories. "Veterinary service, domestic", clinics treating household pets, is permitted by right across most commercial zones and conditionally allowed in the Institutional zone, per the Sec. 3-3-1 land use matrix. "Veterinary service, livestock" is far more restricted, allowed outright only in the Commercial Recreation zone.

Irvine requires every dog off its owner's property to be on a leash no longer than six feet and handled by a competent person. Sec. 4-5-701 bars letting a dog run at large on streets, sidewalks, trails, or someone else's property without consent, with narrow exceptions for approved off-leash dog parks and working dogs on duty.

Keeping four or more adult dogs or cats at an Irvine home makes it a "private kennel," and Sec. 4-5-601 requires a permit from the Director of Public Safety before you can maintain that many. The City reviews sanitation, humane-care conditions, and neighbor input, and can revoke a permit if animals are left unattended over 18 hours or the site turns unsanitary.

Irvine requires a Residential Beekeeping Permit from the Community Development Department before anyone keeps bees on a single-family lot. Zoning Ordinance Chapter 3-41 caps colonies at two Langstroth beehives, sets a 2,400-square-foot minimum lot size, and requires hives in the rear yard, screened, behind fencing, with a posted warning sign.

Irvine does not ban dog breeds by name. Instead, the Municipal Code lets the Director of Public Safety declare any dog "potentially dangerous" or "vicious" based on documented behavior, then order muzzling, a leash no longer than three feet, microchipping, liability insurance, or secure confinement, with a possible City-wide ownership ban.

Irvine requires a permit from the Director of Public Safety before keeping any wild, exotic or nondomesticated animal, or poisonous reptile, inside the City, and the applicant must prove the site is safe and large enough. Unpermitted beehives are also banned citywide.

Irvine bans feeding coyotes, bobcats, mountain lions, raccoons, foxes, skunks, opossums, rodents, rabbits, hares and waterfowl anywhere in the City, with narrow exceptions for veterinarians, licensed rehabilitators, the City shelter, and permitted caretakers.

Backyard composting is permitted in Irvine. SB 1383 requires organic waste diversion. Irvine provides organics collection through Waste Management.

Irvine's Urban Forestry Ordinance (Municipal Code Ch. 4, Div. 7) protects significant trees on public rights-of-way, parks, village-edge common areas and eucalyptus windbreaks citywide. It requires a City Arborist permit before removing any significant tree, bans topping except under a removal permit or emergency, and backs enforcement with misdemeanor penalties tied to the tree's appraised value under International Society of Arboriculture standards.

Irvine declares weeds, rubbish or other material a public nuisance whenever they create a fire hazard, shelter vermin, produce injurious pollen, or cause unsightliness, under Sec. 4-11-301. The Chief Building Official posts a 10-day notice to clean the property; if the owner misses the deadline, the City removes the growth and liens the cost to the land.

Irvine's landscaping code allows synthetic turf in required landscaped areas but treats it as a maintenance obligation, not a design freebie: Zoning Ordinance Section 3-15-3(A) requires synthetic turf to be cleaned and maintained according to the manufacturer's guidelines, the same as any other planted material. The underlying landscaping chapter, however, exempts single-family detached homes from its minimum-landscaping requirements entirely.

Rainwater harvesting is legal and encouraged in Irvine under California Water Code Section 10574 (Rainwater Capture Act of 2012). Rain barrels do not require city permits for standard residential installations.

Irvine Municipal Code § 4-11-101(P) declares overgrown or hazardous vegetation a public nuisance when it 'encroaches into, over or upon any public right-of-way including, but not limited to, streets, alleys, or sidewalks' or blocks a motorist's or pedestrian's view, and the City Council can order the owner to trim it back after a public hearing.

Irvine bars a home-based business from becoming a walk-in storefront: Zoning Ordinance Sec. 2-14-3(B)(2) says the dwelling cannot be "the primary point of customer pickup, delivery or services rendered," and the operation cannot cause a "significant increase in vehicular traffic or pedestrian activity" on the block. Violating either half puts the Home Occupation Permit at risk of revocation.

Irvine's Home Occupation Permit standards flatly prohibit any signage: Zoning Ordinance Sec. 2-14-3(B)(4) states there "shall be no signs, direct sales or other exterior evidence relating to the home occupation." A home business cannot post a yard sign, window sign, or any other visible marker announcing it operates from that address.

Irvine treats a home-based business as an accessory use permitted, by right, in its residential zoning districts, not a conditional use requiring a hearing. The Zoning Ordinance's land use matrix lists a "Home occupation permit" as a permitted use in the Estate, Low, Medium, Medium-High and High Density Residential districts, but every operator must still get a Home Occupation Permit under Chapter 2-14 before starting work.

Small family daycare homes serving up to 8 children are permitted by right in all residential zones in Irvine under California HSC Section 1597.45. Large family daycare homes serving 9-14 children require a use permit.

When Irvine issues a building permit for a new private pool or spa, or the remodel of an existing one, at a single-family home, the pool must have a Health & Safety Code §115923 enclosure plus at least one more layered safety feature: mesh fencing, a rated safety cover, door/window exit alarms, a self-latching door device, or a certified water-motion alarm.

Irvine no longer writes its own accessory dwelling unit standards. Zoning Ordinance Sec. 3-26-1, enacted September 9, 2025 by Ordinance No. 25-22, replaced the city's prior local ADU chapter with a single rule: ADUs must be permitted and regulated under the California Government Code's ADU chapter, Section 66310 et seq. Size, siting and permitting run through state law, not a city table.

A backyard shed, storage building or playhouse in Irvine is a "minor accessory structure" under Zoning Ordinance Sec. 3-5-1. It must sit in the rear yard, stay under 250 gross square feet and 12 feet in height, and can cover no more than half of any required setback area: on top of the city's overall site-coverage cap in Chapter 3-29.

Irvine treats a built-in BBQ grill the same as any other piece of ground-mounted mechanical equipment: § 3-27-8(B) requires it to sit at least 2 feet from the property line, and § 3-27-8(C) caps ground-mounted mechanical equipment in residential districts at 4 feet in height. There's no separate propane or balcony-specific rule in the Zoning Ordinance, these setback and height limits apply to any grill installed as fixed equipment in a yard.

New construction next to hazardous combustible vegetation in Irvine must meet a fuel modification standard tied to Orange County Fire Authority Guideline C-05, not a separate city defensible-space ordinance. Municipal Code Section 5-9-402 adds this requirement directly into the locally amended California Residential Code as Section R301.9.

Warehouse and logistics developments in Irvine must post anti-idling signs limiting heavy-duty truck engine idling to three minutes at site entrances and truck loading bays. A companion rule caps non-essential construction equipment idling at five minutes on new Irvine Business Complex residential and mixed-use projects, matching CARB Rule 2449.

Irvine requires new residential construction and substantial improvements in a mapped flood hazard area to elevate the lowest floor at least one foot above the base flood elevation. The Floodplain Administrator enforces the standard through a mandatory development permit under Zoning Ordinance Chapter 5-2, with a stricter rule for AO Zones lacking a mapped depth number.

Irvine bans illicit connections to the stormwater drainage system and any discharge that pollutes, contaminates, or violates a water quality standard under Municipal Code § 6-8-302. New development and significant redevelopment projects must also prepare a Water Quality Management Plan under § 6-8-303. The Chief Building Official's Authorized Inspectors enforce both sections, with civil, administrative, and criminal remedies reaching every violator.

Before Irvine issues a grading permit, developers must have an approved erosion and sediment control plan on file, install BMPs like desilting basins and check dams, deploy standby protection within 48 hours of a predicted storm, and retain a civil engineer to inspect the system through every rainy season.

Irvine requires a development permit before any construction, fill, grading, or other development begins within a mapped area of special flood hazard. The Floodplain Administrator reviews every application, and building below the base flood elevation without approval is a misdemeanor under the Zoning Ordinance's Floodplain District chapter.

Irvine bans nearly all commercial cannabis activity, but a licensed cannabis testing laboratory may operate if sited at least 600 feet from any residentially-zoned parcel and at least 600 feet from any school, day care center, or youth center under Municipal Code Sec. 4-22-107.

Irvine prohibits every commercial cannabis activity, cultivation, manufacturing, distribution, delivery origin or destination, and retail sale, in all zones and specific plan areas citywide under Zoning Ordinance Chapter 3-39. The city has not opted in to state licensing under MAUCRSA and will not issue any permit or license for a cannabis-related use, with only narrow exceptions for testing labs and inbound medicinal deliveries.

Under California Proposition 64, adults 21 and older may cultivate up to six cannabis plants per household for personal use in Irvine. Plants must be grown indoors in a locked space not visible from a public place. Irvine's community association (HOA) rules may impose additional restrictions on cultivation in many of the city's planned communities. Outdoor cultivation is generally prohibited.

Before any solar energy system goes up in Irvine, rooftop or ground-mounted, residential or commercial, the installer must obtain a building permit under Zoning Ordinance Sec. 3-31-2. Roof-mounted panels are capped at two feet above the roof surface and can't exceed the building's overall height limit, while ground-mounted arrays are barred from every required setback and the front yard.

Irvine processes applications for small residential rooftop solar energy systems through its own Small Residential Rooftop Solar Energy System Expedited/Streamlined Process under Building Code § 107.1.1, rather than routing them through standard plan review: implementing the statewide streamlined-solar mandate at the local level.

California's Solar Rights Act (Civil Code §714) strongly protects Irvine homeowners' rights to install solar panels, which is particularly relevant given the city's numerous HOA-governed communities. HOAs cannot effectively prohibit solar installations. Restrictions that increase cost by more than $1,000 or decrease efficiency by more than 10% are void. Given Irvine's extensive planned community structure, the Solar Rights Act provides critical protections for homeowners.

Irvine treats digital billboards as "electronic message centers", changeable-copy signs run by computer, and requires every one to go through a sign program approved by the Planning Commission before a sign permit issues, per Zoning Ordinance Sec. 7-2-1(B)(8). The only EMC actually built under this rule is the 75-foot Auto Center pylon on Auto Center Drive, capped at 1,100 square feet per face.

Irvine exempts most window signs from a sign permit but caps them by size and message. A permanent window sign identifying a store is limited to 4 square feet with 6-inch letters, while a temporary "open"/sale window sign at a freestanding retail building (outside residential villages) gets a separate 30-square-foot allowance.

Irvine's zoning ordinance limits permanent freeway-facing signage to a narrow set of Village Directional Signs. Signs along freeways between exits top out at 23.5 feet high and 705 square feet; signs at arterial/freeway exits are capped at 10 feet. Copy is restricted to village and directional information, and a sign permit is required.

Irvine treats political signs as "Temporary Non-Commercial Signs": no permit needed, but size is capped at 3 square feet near an intersection or 12 square feet farther away, and election-related signs may go up no earlier than 39 days before the vote and must come down within 10 days after.

Irvine Municipal Code § 4-11-602 finds that letting nonresidential or multifamily apartment property fall out of the maintenance standards in § 4-11-610 'promotes blight and deterioration' and declares any property that isn't safe, is a health hazard, or is unsightly and detrimental to neighbors a public nuisance the City can abate.

Irvine Municipal Code § 4-11-101 defines 'attractive nuisance' broadly enough to reach an unoccupied lot: abandoned wells, excavations, junked appliances, unsound fences, or hazardous debris and vegetation that could hurt curious children. Unlike the streamlined weed notice, the City Council must hold a public hearing under §§ 4-11-102–104 before ordering an owner to clean up a vacant parcel.

Nonresidential buildings, open parking lots and walkways in Irvine must be lit to specific minimum foot-candle levels and shielded fixture heights under the City's Uniform Security Code. Municipal Code Section 5-9-517(K) requires vandal-resistant, fully enclosed luminaires mounted at least three feet high over walkways and eight feet high over vehicle areas, photocell or astronomic-clock controls, and a City-approved photometric site plan before permits issue.

Irvine's Municipal Code sets minimum maintenance standards for multifamily apartment properties under Chapter 6, Division 11, Title 4. Owners must keep building exteriors, paint, windows, lighting, walls and landscaping free of disrepair, and a violation is a misdemeanor the Chief Building Official can abate after a 14-day notice, with unpaid costs assessed as a lien on the property.

California's Tenant Protection Act (AB 1482) applies to most rental properties in Irvine built more than 15 years ago. Annual rent increases are capped at 5% plus the local CPI or 10%, whichever is less. Irvine does not have a separate local rent control ordinance. Many Irvine rentals in newer developments may be exempt due to the 15-year construction threshold.

Under AB 1482, landlords in Irvine must have just cause to evict tenants who have occupied covered units for 12 months or more. At-fault causes include nonpayment, lease violations, and nuisance. No-fault causes include owner move-in, substantial renovation, and market withdrawal. No-fault evictions require one month's rent in relocation assistance.

Commercial dumpsters, roll-off boxes and compactors in Irvine, defined broadly as 'Bins' under Sec. 6-7-101, must come from the City's contracted hauler, display the owner's name and phone number in three-inch letters on two sides, and be kept in safe, sanitary, good-housekeeping condition under Sec. 6-7-403. Unauthorized bins left in the right-of-way can be tagged and impounded.

Irvine requires weekly solid waste collection at every occupied premises through the city's exclusive franchised contractor. Collection cannot happen between 8:00 p.m. and 7:00 a.m., never on Sundays without City Manager approval, and holiday pickups shift one day later.

Any Irvine property subscribed to solid waste service must participate in the organics program its hauler offers and sort food scraps and yard waste correctly - skipping the program or contaminating the wrong bin is a declared public nuisance under the Municipal Code.

Irvine folds yard waste, 'all leaves, grass cuttings and shrubs that accompany routine household or property maintenance functions' under Sec. 6-7-101, into its exclusive franchised hauling system, but Sec. 6-7-601(I)(4) exempts gardeners and landscapers who haul clippings themselves as an incidental part of their service, so residents don't need a separate permit for routine yard work removal.

Irvine's Municipal Code bars anyone from discarding waste material, household rubbish, garbage or any other refuse, on public or private property anywhere in the city, including streets, alleys, rights-of-way and stormwater inlets. Section 6-8-303(D) also puts a collection duty on the property owner when dumping happens on their land, and the offense is chargeable as either a misdemeanor or an infraction under Title 4, Division 13.

Irvine guarantees at least weekly trash pickup for every occupied property and keeps trucks off residential streets late at night: Sec. 6-7-501 bars collection between 8:00 p.m. and 7:00 a.m. and on Sundays, and pushes holiday routes back a day for six named holidays.

Furniture and other bulky items that won't fit in a standard cart must be covered and secured. Sec. 6-7-405(D) requires a tarp, netting or similar material to stop debris from scattering, and makes the property owner or occupant responsible for cleaning up anything that spills from an overflowing container.

Irvine caps how long trash, recycling and organics carts can sit at the curb: Sec. 6-7-405(C) bars setting a bin or cart out more than 24 hours before the scheduled pickup and requires it back off the street or right-of-way by noon the day after collection, with curb or alley placement set by Sec. 6-7-405(A).

Irvine requires every mobile food preparation unit to hold a food vending permit from the Orange County Health Care Agency before operating, issued under City Code Sec. 4-10-402. Operators serving multiple stops in a day must list three service locations on the application and meet added safety standards under Sec. 4-10-407 and 4-10-408.

No one may operate a sidewalk vending cart in Irvine without first obtaining a sidewalk vendor permit from the City Manager under Municipal Code Section 2-10-1403. The 20-item application, adopted to implement Senate Bill 946, covers identity, receptacle dimensions and insurance, and every permit expires every December 31 regardless of issue date.

Irvine bans all sidewalk vending, roaming or stationary, between 10:00 p.m. and 7:00 a.m., and stationary vending is banned outright in residential areas. Roaming vendors in residential neighborhoods can only operate 9:00 a.m. to 6:00 p.m. or sunset Monday through Saturday, and not at all on Sundays or federal holidays, under Section 2-10-1406.

Door-to-door solicitors and canvassers in Irvine cannot knock without a prior appointment before 9:00 a.m., after sunset, on Sundays, or on national holidays, and any premises posted with a no-soliciting sign is off-limits entirely under Municipal Code Sections 2-10-902 and 2-10-903. Newspaper peddlers are the only group exempt from the hours limit.

Irvine regulates door-to-door solicitation through its municipal code under Title 4 (Public Safety). Commercial solicitors must obtain appropriate permits and a business license. The city requires identification and may require background checks. Soliciting hours are restricted to protect residents. Religious and political canvassing is generally exempt.

Zoning Ordinance § 3-37-13(I) sets a 5-foot side and 10-foot rear setback against another residential lot, rising to 10 feet on both sides when the neighbor is nonresidential.

Irvine caps residential building height at 35 feet in its Low Density Residential zone and 50 feet in Estate Density Residential, measured under the citywide standard in Zoning Ordinance Section 3-9-1. Architectural features, antennas and flagpoles may rise up to 10 feet above the limit, 15 feet for Class 4 antennae, without a Planning Commission conditional use permit; taller still requires one.

Irvine HOA boards may raise regular assessments up to 20 percent annually without a member vote under CA Civil Code 5600. Liens require 30 days written notice.

Irvine's zoning ordinance expressly defers to homeowners association rules when a property owner applies for a state-mandated SB9 duplex. Under Section 3-42-6, an HOA's recorded CC&Rs may prohibit or add restrictions on a duplex the city would otherwise allow, and the city will deny the permit if the HOA has not approved it in writing.

Irvine HOAs must follow the Davis-Stirling Act (CA Civil Code 4000-5975) for open meetings, elections, budgets, and financial disclosures to all members.

Irvine HOAs must review architectural applications within 60 days under CA Civil Code 4765. Solar panels, native plants, and EV chargers are protected by state law.

Irvine HOA disputes require internal dispute resolution (IDR) and alternative dispute resolution (ADR) before most lawsuits under the Davis-Stirling Act.

Filming in Irvine is regulated as a special event: Sec. 1-18-143 pulls film productions into the same permit chapter as carnivals and other non-conforming property uses, and Sec. 2-10-804 makes it unlawful to shoot without a special event permit from the Administrative Authority, issued before filming starts and tied to one specific site.

Any film shoot that will close an Irvine street counts as a 'special event' under Sec. 2-10-802 and needs the same permit as a parade or festival. The Administrative Authority can condition approval on keeping at least one traffic lane open during work days and requiring cones, delineators, or barricades to protect the crew and the public.

Because Irvine regulates film productions through its Special Events permit chapter, a shoot's noise can sink the permit outright: the Administrative Authority must deny an application if noise would substantially disrupt a nearby school in session, or disturb an adjacent hospital or fire station, and may condition approval on restricting amplified sound.

A Group R-3 residential remodel or addition permit in Irvine becomes invalid unless the City completes and approves the work within 18 months of issuance. The building official can grant one written 6-month extension; anything beyond that needs the Community Development Director's sign-off, and neighbors within 300 feet may appeal to the City Council.

Irvine enforces green building requirements not through a standalone local ordinance but by adopting the California Green Building Standards Code (CALGreen), 2025 edition, by reference under Sec. 5-9-101(10). Effective November 12, 2025, this Title 24, Part 11 code, layered onto the City's Building, Residential, Electrical, Mechanical, Plumbing and Energy Code adoptions, sets Irvine's mandatory sustainability, water-efficiency and construction-waste standards for new construction.

Irvine enforces electrical work through the 2025 California Electrical Code, based on the 2023 National Electrical Code, adopted by Municipal Code Section 5-9-101. A permit is required for virtually every electrical installation covered by the adopted codes, and the City adds its own rule banning new outside wiring on private property from running overhead.

Opening a child care center in Irvine requires three approvals before day one: a state child day care license, a City conditional use permit, and a City business license. Zoning Ordinance Section 3-10-1 then layers on detailed indoor and outdoor design standards, separate play areas by age group, minimum equipment fall zones, and specific surfacing, enforced by the Building Official.

Any parade, procession, or march that uses an Irvine street, sidewalk, or other City property needs a special event permit from the Administrative Authority before it proceeds. Street parades or those with more than 50 participants must file at least one week ahead; smaller sidewalk parades need only three days' notice.

Irvine folds commercial film productions into its Special Events permit track: Municipal Code § 1-18-143 requires any business activity involving film productions to comply with Chapter 8's special-events permitting, so a production cannot shoot on the strength of a business license alone. Any group planning a parade, picnic, meeting or assembly of more than 50 people at an Irvine public facility must notify the Director of Community and Library Services at least 30 days in advance under Municipal Code Section 3-4-123. Setting up an exhibition, concert or performance in a public place requires a separate permit from the same Director.

Irvine declares it a public nuisance to place personal property, sporting equipment, or a trash, storage or metal bin on a sidewalk, street, easement or right-of-way under Sec. 4-11-101(T)-(U). Irvine assigns sidewalk repair duty to the property owner, not the City. Municipal Code Section 6-3-316 requires any owner whose lot fronts an improved street, park strip, or parking strip to keep the abutting sidewalk in a condition that will not endanger pedestrians or interfere with public use, unless a City permittee caused the damage.

Placing or maintaining anything in an Irvine public street or right-of-way without a permit is a misdemeanor. Encroachment permits are issued by the Chief Building Official, run up to six months unless the City Council approves longer, and can be revoked if the encroachment interferes with safe public use.

Irvine caps delivery- and pickup-truck activity at commercial properties that share a lot line with a residential property to 7:00 a.m.-10:00 p.m. daily under Municipal Code § 6-8-205(A). The rule targets loading-dock and truck noise next to homes rather than deliveries citywide, and it applies seven days a week with no waiver clause for this specific hour band.

Irvine caps the noise from air conditioning, refrigeration, and heating equipment, plus pool and reservoir pumps, filters, and heaters, under Municipal Code § 6-8-205(C). The limit is whichever is higher: the Section 6-8-204 exterior noise table for the property's land-use type, or five decibels above the existing ambient level. A rattling condenser or pool pump that beats both benchmarks is a Code violation.

Landscape plans for new development within 100 feet of the San Joaquin Marsh or San Diego Creek in Irvine's IBC Residential Mixed-Use Overlay District may not include exotic plant species that could invade native habitat. The Zoning Ordinance bars any species on Lists A and B of the California Invasive Plant Council's inventory of ecologically damaging exotic pest plants.

Irvine's code has no citywide residential camera or Ring-registry rule, but it does mandate a full HD camera surveillance system for every convenience store, mini market, and liquor store: cameras at each register, all entrances, and fuel islands, with 30-day digital recording retention.

Irvine Chapter 6 prohibits the sale, offer for sale, and use of any flavored tobacco product citywide, including fruit, candy, menthol and mint vapes, under Sec. 4-10-603, adopted in 2020 as an urgency ordinance. Hookah tobacco and hookah use are the sole carve-out. Underage violators face device confiscation and an infraction, with a diversion-program option.

Irvine protects working farmland through a dedicated 1.1 Exclusive Agriculture zoning district under Zoning Ordinance Sec. 3-37-2, which limits the land to agriculture and closely related accessory uses on parcels of at least 50 acres.

Irvine bans camping, encampments and vehicle habitation on public property not designated for it, and on private property without owner consent. The City Manager abates encampments under a written 24-hour Notice of Clean-Up, storing eligible property for 90 days before disposal. Violations are misdemeanors.

Irvine adopts the state's Class 1/2/3 e-bike definitions by reference, then caps speeds at 28 mph on public highways, 10 mph on sidewalks (5 mph near schools), and 20 mph on bike paths, with mandatory helmets for Class 3 riders of any age.

Irvine caps motorized scooters, including shared e-scooters, which the code (via Vehicle Code § 407.5) expressly counts as motorized scooters, at 15 mph on bicycle paths and trails, bars them from parks except on routes the Community Services Department designates, and lets police impound any scooter ridden in violation, with fines starting at $100.

Irvine requires cyclists moving slower than traffic to stay in a marked bicycle lane under Sec. 4-7-208, letting them leave only to pass, turn left, or dodge debris, and Sec. 4-7-204 caps group riding at two abreast. Riding unsafely in or against a bike lane is enforced as a traffic infraction with fines up to $500 for repeat violators.

Irvine caps stationary-source noise at the receiving property. At homes (Noise Zone 1), exterior noise cannot exceed 55 dB(A) daytime (7 a.m.-10 p.m.) or 50 dB(A) at night (10 p.m.-7 a.m.). Municipal Code Sec. 6-8-204 sets the table; data-center cooling and generators must comply.

The City of Irvine has no data-center ordinance and no "data center" use category. Data centers locate in the IBC Industrial (5.2) and General Industrial (5.4) districts as office, research-and-development, service-industry, or light-manufacturing uses - permitted by right, no conditional use permit.

Where a hillside development project in the San Joaquin Hills or Lomas de Santiago Hills review area requires permanent irrigation, Irvine's Hillside Overlay ordinance directs landscaped common areas to use recycled water whenever feasible and an adequate recycled-water supply exists. The rule sits inside the broader hillside grading and revegetation standards reviewed under Zoning Ordinance Section 5-4-4.

Irvine implements California's density bonus law locally through Zoning Ordinance Sec. 2-3-10, granting density bonuses and incentives "in accordance with California Government Code §§ 65915: 65918" to housing developments that set aside units for Very Low, Low, or Moderate income households, or seniors, and layers two additional local land-donation bonuses on top.

Under Irvine Municipal Code § 4-11-610(A), owners of nonresidential and multifamily apartment property must keep building surfaces and roofs free of significant cracks, missing materials, and warping caused by dry rot, pest infestation or fungus that threaten structural integrity or leave the building looking dilapidated. It is one of eleven maintenance standards enforced under the City's Property Maintenance chapter.

Irvine imposes an eight percent transient occupancy tax on every hotel, motel, or short-term rental stay of 30 consecutive days or less, effective July 1, 1983. The operator collects the tax from the guest at the time rent is paid and remits it to the Director of Administrative Services, who also issues the registration certificate every operator must post.

Operating a massage establishment in Irvine without a City permit is unlawful: owners need both a massage establishment permit and a business license, and every technician performing massage must hold current California Massage Therapy Council certification. The Director of Public Safety can take up to 90 days to investigate each applicant before granting the permit.

Every tattoo shop in Irvine must run hot and cold water, sterilize equipment in an autoclave, disinfect stencils in 70 percent alcohol, and disclose its dye and ink sources to the Health Officer under Municipal Code Chapter 13. The County Health Officer inspects each shop and collects an annual service fee.

Irvine requires every sexually oriented business to obtain both a sexually oriented business permit and a city business license before operating. The permit is confined to General Industrial or IBC Industrial zones and comes with strict distance separations from homes, schools, parks, churches and other adult businesses.

Irvine makes it unlawful to loiter, stand or sit on a public highway, alley, sidewalk or crosswalk in a way that blocks pedestrians or vehicles, or to accost or molest passersby, under Municipal Code Sec. 4-14-105. Because the chapter doesn't designate it an infraction, a violation defaults to a misdemeanor punishable by up to six months in jail or a $1,000 fine.

Irvine makes it an infraction to carry an opened alcohol container on any public street, sidewalk, alley or parking lot under Sec. 4-14-113, and separately bans actually drinking any alcoholic beverage on streets, parks, beaches, public squares or in a car in a public place under Sec. 4-14-114. Both provisions exempt drinking done under a City-issued permit, such as a licensed park concession.

Riding a skateboard unsafely on any Irvine street, sidewalk, bike path, trail or park is unlawful under Municipal Code Section 4-7-206, which bars riding against traffic, popping wheelies, ignoring posted no-skate signs, and failing to yield to pedestrians entering from a driveway or sidewalk.

Irvine Municipal Code § 4-11-502 lets a police officer who responds to a loud or unruly gathering issue a written warning notice; any further police response to the same address within 30 days becomes a billable 'special security assignment.' Section 4-11-501 defines 'unruly or loud conduct' broadly, from street-blocking crowds to public drunkenness, assault or vandalism.

Irvine bans urinating, defecating or disposing of human waste anywhere exposed to public view or on any public street, sidewalk, alley, park, parkway or parking lot, under Municipal Code Sec. 4-14-111, unless it happens in a proper restroom fixture. The only exception covers someone medically unable to control excretory functions, and it doesn't apply if that loss of control comes from voluntary alcohol or drug use.

Irvine bans smoking, a term the code defines to include marijuana and vape smoke, in every public place, from parks and sidewalks to outdoor dining patios and multi-unit residence balconies, under Sec. 4-10-503. Smoking stays legal only on private residential property, inside separately accessible commercial or hotel space, or in a moving vehicle. Violators face an infraction.
