Local Rules Near Downtown Gilbert

Code of Gilbert § 62-4 bans four specific vehicle noises: tire squealing from aggressive acceleration or turning, illegal horn or signal use, defective or modified exhaust systems that create excessive noise, and revving a stationary engine outside 7 a.m. to 7 p.m. except for repair, adjustment, or testing. Every violation is a civil traffic offense.

Gilbert sets numeric noise ceilings by zone and time of day. Code of Gilbert § 42-61(e)(1) caps residential noise at 45 dB(A) overnight and 55 dB(A) by day, commercial areas at 55/65 dB(A), and industrial areas at 60/70 dB(A), measured inside the complainant's closed building.

Gilbert's noise ordinance carves aircraft noise out of local enforcement entirely. Code of Gilbert § 42-61(c)(10) lists "noises created by aircraft" among the activities exempt from the town's community noise standards, so helicopter and airplane overflight noise is not measured against the decibel limits that apply to other sources inside town limits.

Amplified sound in Gilbert's public areas needs a police permit first. Code of Gilbert § 42-62(b) bars operating a sound truck, loudspeaker, radio, or sound amplifier that emits unreasonable noise from public areas unless the operator has a permit from the chief of police, granted at the chief's discretion.

Gilbert prohibits unnecessary, excessive, and offensive noises under Chapter 42 of the town code. The policy protects residents from noise detrimental to health, safety, and welfare at certain levels.

Gilbert sets fixed construction hours that shrink on weekends. Code of Gilbert § 42-63(b) allows concrete pouring from 4:00 a.m. to 10:00 p.m. and other construction near residential zones from 5:00 a.m. to 10:00 p.m. on weekdays, tightened to 7:00 a.m.–7:00 p.m. on Saturdays, Sundays and holidays.

Gilbert's noise ordinance makes it unlawful to keep or harbor any animal whose frequent, habitual or continued noise annoys a neighbor or people on public streets or sidewalks. Section 6-2 of the Code of Gilbert requires at least two complaining witnesses from separate households, each of whom must sign the complaint and testify at trial, before a citation can result in conviction.

Gilbert's Code of Ordinances makes it unlawful to use a leaf blower to blow landscape debris into a road, and separately caps when lawn maintenance equipment, including blowers, can run without meeting the town's decibel limits. In residential areas that noise exemption covers only 5:00 a.m. to 10:00 p.m.; outside that window equipment must meet the 45 dB nighttime standard.

The Town of Gilbert imposes NO annual or per-stay night cap on short-term rentals. Arizona Revised Statutes § 9-500.39 expressly preempts cities and towns from prohibiting STRs or capping the number of nights or units used as vacation rentals. Stays under 30 consecutive days are taxable transient lodging.

The Town of Gilbert requires every short-term rental owner to obtain a Town STR License under Town Code Chapter 14, Article III (adopted June 2023). The license costs $100 initially and $100 to renew annually, and applicants must hold an active Arizona TPT license, carry $500,000 liability insurance, and designate a 24/7 emergency contact.

Gilbert makes it unlawful for anyone, including a booking platform, to accept a fee for facilitating the rental of a short-term rental that is operating in violation of town or other law. Code of Gilbert § 14-80(e) targets the money trail, not just the property owner, and § 14-80(f) separately bans aiding or abetting any Article III violation.

A Gilbert short-term rental with three verified violations in 12 months, or even one serious verified violation, can have its license suspended for up to 12 months under Code of Gilbert § 14-82. Civil penalties also escalate under § 14-83, from up to $250 for a first violation to up to $1,750 for a third.

Gilbert STRs must comply with general noise ordinance. Under SB 1168, cities can fine and suspend properties with repeated verified noise violations.

Gilbert requires STR operators to collect and remit Transaction Privilege Tax on all short-term stays. A town STR license and state TPT license are both required for legal operation.

Gilbert mandates one off-street parking space per bedroom for all short-term rentals. All vehicles must be parked on improved surfaces meeting town standards.

Gilbert caps how much liquefied petroleum gas or other hazardous material a residence may store. Under Code of Gilbert Sec. 10-37(b), amending 2018 International Fire Code Section 5003.1.1.1, residential use and storage cannot exceed one half of the amounts allowed by the fire code's general hazardous-materials tables, or 15 gallons of liquid or 150 pounds of solids, whichever amount is less.

Code of Gilbert § 42-253 makes it unlawful and a public nuisance to burn refuse anywhere in town except in incinerators permitted by the county and the town's director of public works. Any refuse burning that produces particulate matter or offensive, obnoxious or dangerous fumes or odors is a nuisance and is flatly prohibited, permit or not.

Gilbert prohibits consumer fireworks year-round except during state-mandated legal periods (May 4-6, June 24-July 6, Dec 24-Jan 3). Fireworks are prohibited on all public property. Violations carry a $1,000 fine.

Gilbert's Land Development Code requires off-street loading spaces for commercial, office and employment uses with 10,000 square feet or more of gross floor area that receive deliveries by trucks 36 feet or longer. One loading space is mandatory at that threshold, with an added space for every additional 40,000 square feet, and the spaces must stay clear of residential property.

Code of Gilbert § 62-76 lets the town manager designate all or part of any publicly owned parking lot or garage as a permit-or-decal-only zone; anyone parking there during the posted hours without a current, properly displayed town-issued permit or decal is in violation.

Code of Gilbert § 62-69 bars parking any vehicle rated over one ton, or any tractor, semitrailer, trailer, bus, or RV, in the public right-of-way on or next to a residential street, except while actively loading or unloading, and even then for no more than 48 hours.

Gilbert's Land Development Code bars parking a motor vehicle, recreational vehicle, boat or trailer in the front or side setback where it's visible from the street. These vehicles must sit on a driveway or on an approved additional parking space instead, and can never block access to a required parking stall, carport or garage.

Gilbert enforces abandoned and inoperable vehicle regulations. All vehicles on residential property must be operational with current registration and parked on improved surfaces.

Gilbert requires all vehicle parking on improved surfaces. Approved areas are the garage, driveway, and adjacent improved areas. Parking on dirt, grass, or landscape is prohibited.

Gilbert regulates on-street parking through traffic ordinances. Vehicles must not obstruct traffic or emergency access. Some areas have posted time limits and overnight restrictions.

Code of Gilbert § 62-74 lets the town prohibit overnight parking on town property and bans parking a vehicle overnight anywhere the town has posted signs against it; § 62-68 separately lets the council set time limits on any street where limit signs are erected.

Every fence, screen wall and retaining wall in Gilbert has to stay safe, structurally sound and free of blight under Code of Gilbert § 42-316(c). Leaning panels, rot, missing slats or blocks, graffiti or peeling paint all count as violations, and code compliance officers can issue a notice of violation giving the owner 30 days to fix it before a citation and civil fine follow.

A worn-out wall or fence sitting on a Gilbert property line can stay put if it's well maintained, but rebuilding it to today's height standards takes written sign-off from every owner it abuts. Land Development Code § 5.2.9(A)(3) puts that call in the neighbors' hands, not one owner's, and routes disagreements into the Town's formal Wall and Fence Modification process rather than letting either side act unilaterally.

Gilbert's Land Development Code bars retaining walls from reading as a single flat surface and caps them at the base zoning district's maximum wall height. Walls stacked within five feet of another wall trigger a mandatory five-foot planted terrace between them, with height measured from the top of the highest wall to the toe of the lowest.

Gilbert's Land Development Code specifies acceptable fence materials. Block walls, wrought iron, and vinyl are standard. Barbed wire is prohibited in residential zones. Many communities have HOA material requirements.

Gilbert's animal code does not require stray cats to be picked up the way stray dogs are, but any cat that is impounded gets the same proper care as an impounded dog under Code of Gilbert § 6-102. An impounded cat may be purchased after a 72-hour hold if unclaimed, or reclaimed by its owner on proof of ownership and payment of pound fees.

Gilbert prohibits dogs from running at large under Code of Gilbert § 6-60: every dog must stay confined to the owner's property in an enclosure, or on a leash no longer than six feet and directly under the owner's control, whenever it leaves that property. Designated off-leash areas in dog parks are the main blanket exception besides livestock work, hunting, kennel events and organized obedience training.

Gilbert's Land Development Code lets residents keep apiaries in any residential zoning district by right, with one numeric condition: every hive location must sit at least 100 feet from any property line. There is no stated cap on hive count, unlike the Code's fowl provisions next to it.

Gilbert regulates farm animals on residential lots through the town code. The number and type of animals depends on zoning district and lot size. Gilbert's agricultural heritage areas may have more permissive standards.

Gilbert bans feeding wild or feral animals on town-owned property or in the public right-of-way. Code of Gilbert § 6-7, adopted by Ordinance No. 2664 in 2018, allows only one narrow exception: the parks and recreation director may authorize specific people to feed wild or feral animals for rescue, rehabilitation or management purposes.

Gilbert's Land Development Code sets a minimum planting size for every approved tree: six feet for deciduous and non-deciduous trees (typically a 24-inch box), five feet for palms, and a 0.75-inch trunk caliper measured four inches above the soil line for single- and multi-trunk trees.

Code of Gilbert § 42-317(e) makes lawn grass or weeds taller than ten inches a code violation on any exterior property area, vacant or improved, along with tumbleweeds and dead palm fronds left within ten feet of a structure, fence or other combustible. The town enforces it through the same 30-day abatement notice and $500 civil fine used for other property-maintenance violations.

Gilbert restricts lawn watering only when the town manager or council declares a water-shortage stage under Code of Gilbert § 66-381. Stage three lets the town publish time-of-day, address or other restrictions on lawn watering, and stage four bans watering lawns outright, along with lawn overseeding, fountain operation and new pools, per § 66-383.

Gilbert makes the owner, occupant or person controlling a property responsible for keeping the sidewalk out front clear of grass, weeds and rubbish and for trimming vegetation so it doesn't block pedestrian or street travel, under Code of Gilbert § 54-5. The same section requires frontage irrigation ditches and retention berms to be kept in repair so they don't dump water onto public property.

Running a home business in Gilbert means client and delivery traffic can't exceed what's normal for the residential street it's on. The Land Development Code's home occupation rules cap vehicle and truck trips at ordinary neighborhood levels and require that any related parking happen entirely on the business owner's own lot.

Running a home daycare in Gilbert as a Residential Day Care use, six to ten children or adults under Land Development Code § 2.0, is allowed only as an accessory use meeting Land Development Code § 5.1.4. The rule caps outside staff at one full-time-equivalent employee, requires a screened six-foot play-area enclosure, and sets a 300-foot separation from any other home daycare on the same street.

Every home-based business in Gilbert needs the same yearly business license as a storefront: there's no separate home-occupation permit. Code of Gilbert Section 14-36 requires anyone engaging in business from a fixed location, including a home, to obtain a license and pay a yearly fee, with the application reviewed by the development services director within 30 days.

Gilbert's Community Preservation Ordinance requires every pond, pool, and spa on a property to be kept free of stagnant or foul water and clear enough that the main drain is visible from the pool deck. The same section cross-references the LDC's enclosure fencing requirement as part of the maintenance duty.

Above-ground pools in Gilbert must meet the same barrier requirements as in-ground pools. Pools with non-climbable walls at least 5 feet high with secured ladders may serve as the barrier.

Gilbert's Land Development Code states directly that an accessory dwelling unit may be rented or leased separately from the principal dwelling: there is no owner-occupancy requirement or minimum-tenancy rule in this section, and the allowance is repeated for the larger, permit-tier ADUs as well.

In Gilbert's SF-43 single-family district, the Land Development Code lets you build an unlimited number of detached accessory structures like sheds and workshops, but caps them at 30 feet tall and ties every one to the same setbacks as the house unless it sits in the rear two-thirds of the lot, where a reduced 5-foot setback applies only under 10 feet in height.

Gilbert's LDC caps single-family lots at one detached and one attached accessory dwelling unit, with a second detached unit allowed only on parcels of an acre or more if one ADU is restricted-affordable. Every ADU is also capped at 75% of the primary home's floor area and cannot exceed the base district's height or lot coverage.

Gilbert enforces stormwater management through Ordinance 1590 and the Arizona Pollutant Discharge Elimination System (AZPDES). Construction sites disturbing one acre or more must obtain coverage under the construction general permit. The Sonoran Desert environment makes stormwater retention critical due to flash flood risks from monsoon storms. Gilbert requires on-site retention for new development to manage runoff.

The Town of Gilbert lets developers start preliminary on-site grading before their improvement plans are fully approved, but only under an At-Risk Grading Permit issued by the Development Engineering Manager. All early work is done entirely at the applicant's own risk and expense under Land Development Code Chapter 3 § 1.5.

Gilbert's Land Development Code allows a dedicated Freeway Sign only on parcels of at least 15 net acres in Commercial, HVC/GVC/GBC, Office, Employment, Public Facility/Institutional or Mixed-Use districts abutting a freeway. One sign is allowed per 400 feet of freeway frontage, capped at 500 square feet and 60 feet in height.

Gilbert's Land Development Code caps window signs at less than 25 percent of the window area they're displayed in, requires no permit for a compliant window sign, and bars them on single-family residential property while allowing internal, optional illumination where they are permitted.

The Town of Gilbert's Land Development Code bans billboards outright, and the ban covers digital and electronic displays the same as static panels. Section 5.6.3 lists Billboards among the Town's prohibited sign types, and a standalone severability clause in Section 5.6.16 protects that specific ban even if a court strikes down other parts of the sign chapter.

Gilbert's Land Development Code defines "sign" to exclude yard decorations from regulation entirely, so a seasonal inflatable Santa, pumpkin or snowman displayed at a home isn't subject to the Town's Sign Regulations chapter. The Section 5.6.3 ban on "Inflatable Signs" reaches only inflatables used to advertise a commercial or noncommercial message, not pure holiday decor.

Gilbert allows up to three temporary signs for garage/carport/yard sales. Signs may be placed on private property but not in the public right-of-way or on utility poles. Signs must be removed promptly after the sale. The town's sign code was revised following the Reed v. Town of Gilbert Supreme Court decision to ensure content-neutral regulation.

Gilbert's Land Development Code exempts political signs from its sign regulations altogether, deferring to the protections Arizona law gives them under A.R.S. § 16-1019, so the Town does not impose its own size, timing or permit rules on political signs the way it does for commercial signage.

Gilbert requires every parcel, vacant or improved, to stay free of weeds, tumbleweeds and tall grass under Code of Gilbert § 42-317. Vegetation over ten inches tall, dead palm fronds within ten feet of a structure or fence, and accumulated debris are all code violations. Code Compliance inspects on complaint or patrol and issues a notice before any citation.

Code of Gilbert § 42-316 requires every structure's exterior, surfaces, windows, doors, fences, foundations and roofs, to be kept free of deterioration or a 'blighted appearance.' The town can issue a 30-day notice to abate under § 42-311, and Municipal Court fines run up to $500 per violation under § 42-334(b).

Gilbert requires floodlights, spotlights and other high-intensity security or site fixtures to be fully shielded so the lamp isn't a source of glare, and building- or pole-mounted flood and spotlights must be aimed at less than 45 degrees below horizontal so the beam doesn't spill onto neighboring property.

Gilbert's Code of Ordinances requires every outdoor light fixture in town, residential included, to be designed to cut spill light into the night sky, reduce impact on neighborhoods, and follow Illuminating Engineering Society of North America practices. Anyone installing a new fixture must first prove compliance to the development services division with photometric data before the town issues a permit.

Gilbert requires every owner of commercial rental property in town to hold a business license, and Code of Gilbert § 14-37(e) goes further: a landlord needs a separate license for each individual rental property, not one blanket license for a portfolio. The license runs one year from issuance under § 14-36(c) and is administered by the development services director.

Code of Gilbert § 42-108 makes it a civil nuisance offense to let any structure, including a rental unit, become unsafe or deficient: blocked egress, inadequate light or ventilation, fire hazards, illegal occupancy, broken exterior doors, windows or fences, or an unsecured vacant building. The town building official can order repair or removal under Section 115 of the 2006 International Building Code.

Code of Gilbert § 66-266 makes it unlawful to place refuse on any public or private property in town except as specifically permitted, and § 66-275 escalates repeat offenders from a civil citation to a class one misdemeanor after three violations in 18 months. Owners of vacant land hit by repeat dumping must secure the site under § 42-317(f).

Gilbert requires anyone placing a private recycling drop-box in town, the kind churches or nonprofits host in a parking lot, to hold a town permit, keep the container under six cubic yards, and never let materials pile up outside it. Contaminated or unlisted materials in the box are illegal.

Gilbert requires commercial refuse containers and compactors to sit in an inconspicuous location and lets the public works director order relocation to meet town zoning and other requirements. Any new or altered fence enclosing a dumpster along an alley or next to multifamily, commercial or industrial zoning needs the director's approval, and enclosure standards come from that office.

Gilbert lets residents bag yard waste into the regular black roll-out container if there's room, or set out a combined yard-waste-and-bulk pile up to five feet by five feet by ten feet on the recurring bulk trash schedule. Brush and tree limbs can't exceed five feet long or 12 inches thick.

Gilbert collects bulk trash on a regular recurring schedule for single-family homes under Code of Gilbert § 66-288(d), but caps each pile at five feet by five feet by ten feet and limits brush to five feet long and 12 inches in diameter. Materials must go out no earlier than the Saturday before, and no later than 5 a.m. the Monday of, the scheduled collection week.

Gilbert's public works director sets the days and hours for trash pickup, and regular refuse service runs once a week for every single-family home. Bulk trash follows its own recurring recurring schedule and cannot be used for waste generated off-site or from home occupations.

Gilbert requires trash and recycling containers to be stored out of public view when not set out for collection. The town provides automated collection through its contracted hauler. Bins must be placed at the curb the evening before or by 5:00 AM on collection day and retrieved by 9:00 PM. Gilbert's code compliance FAQ lists visible trash containers as a common violation.

Gilbert requires collection containers to sit at the curb line with at least three feet between them, set out no earlier than 6:00 p.m. the evening before pickup and pulled back in by 6:00 a.m. the next morning. Containers must stay hidden from the street between collection days.

Gilbert requires curbside recyclables to be clean, empty, dry and loose, never bagged or sealed in a box, before they go in the town's recycling container. Only material that fits that standard gets collected, and shredded paper must be bagged clear so collectors can see it.

Gilbert treats a drone the same as a radio-controlled model plane or model car under Code of Gilbert § 46-4: flying one within 50 feet of a reserved area boundary in a town park is unlawful interference with the permit holder's exclusive use. The rule protects reservation permits, not general park airspace town-wide.

Mobile food vendors and food trucks in Gilbert must hold a Town business license before operating and may not sell on town property or the public right-of-way without a written agreement or permit, per Code of Gilbert § 14-138. Ice cream trucks and human-powered carts get a narrow right-of-way exception limited to ten minutes per stop.

Every mobile food vendor operating a food truck, ice cream truck or human-powered cart in Gilbert needs a business license under Code of Gilbert § 14-137, and a separate license for each vehicle. The application includes a vehicle photo and description, proof of liability insurance, and, for vendors working town property or right-of-way, a felony disclosure.

Gilbert lets food trucks, ice cream trucks and food carts operate almost anywhere except where Code of Gilbert § 14-138 draws the line: no town property or right-of-way without a written agreement, no public park without a parks and recreation permit, and no congested area where a police officer judges the business impedes the public.

Anyone conducting door-to-door sales, solicitation or order-taking in Gilbert as a 'transient merchant' must first obtain a Town business license under Code of Gilbert § 14-168, file a detailed application with the development services director, and follow strict location limits, or face civil penalties.

Posting 'No Peddlers,' 'No Solicitors,' 'No Transient Merchants' or 'No Trespassing' at a Gilbert home bars any transient merchant from knocking or ringing the doorbell there, per Code of Gilbert § 14-171. After three documented violations at the same address within a year, the code compliance inspector's case carries a mandatory $500 fine.

Gilbert closes every town recreation facility outside its posted operating hours under Code of Gilbert § 46-31. Anyone present when a park isn't open to the public, other than town staff conducting business, is committing a civil offense, unless a parks-and-recreation-director permit specifically extends hours for a scheduled function.

Code of Gilbert § 42-143 bars anyone under 16 from being away from home between 10:00 p.m. and 5:00 a.m., and 16- or 17-year-olds between midnight and 5:00 a.m. Parents or guardians who knowingly let a minor violate curfew, or who refuse to retrieve a detained minor, are separately liable under the same section.

Gilbert's Land Development Code caps single-family lot coverage by district, 35% for both one-story and two-story homes in the mid-sized SF-15 district, then layers on two bonuses: 5% extra for open-air patios, porches, and accessory structures, and 10% extra for homes over 20 years old to encourage redevelopment.

Gilbert's Land Development Code establishes minimum setback requirements by zoning district. Residential districts typically require front setbacks of 20-25 feet, side setbacks of 5-10 feet, and rear setbacks of 15-20 feet. Any building 200 square feet or larger requires a building permit. HOA CC&Rs in many Gilbert subdivisions may impose additional setback requirements beyond the town code.

Gilbert caps single-family homes at 35 feet and two stories in its largest-lot districts, SF-43 and SF-35, stepping down to 30 feet and two stories in SF-15, while its small-lot SF-D and SF-A districts allow up to 36 feet and three stories. Height is measured from finished grade to mid-roof under LDC § 2.0, and homes backing higher-density or non-residential parcels are capped at one story.

Gilbert's Land Development Code requires one street tree per 30 linear feet of arterial street frontage, a 50-by-250-foot landscape area at every arterial intersection, 20 feet of landscape buffer along arterial streets and 10 feet along collector and local streets, planted from the Town's low-water plant list.

Gilbert allows garage, carport, and yard sales with specific regulations. Sales are limited to daytime hours between 8:00 AM and 10:00 PM. A maximum of three temporary signs are permitted per sale. Items must be on private property. The town code prohibits converting a garage to another use unless equivalent covered parking is provided elsewhere.

Gilbert adopts the 2018 International Building Code and 2018 International Residential Code by reference under Code of Gilbert Sec. 10-31, so most new construction, additions and alterations need a town-issued building permit. A locally amended Section R105.2 exempts only limited work, such as detached non-habitable accessory structures of 200 square feet or less, and violations bring escalating civil penalties under Sec. 10-50.

Plumbing work in Gilbert must follow the "International Plumbing Code, 2018 Edition," which Code of Gilbert Sec. 10-34 adopts by reference together with its Appendix B. The town files a copy with the town clerk for public inspection, and Sec. 10-50 folds Sec. 10-34 into the same enforcement track used for the town's other adopted technical codes.

Gilbert has adopted a green building standard, but it is optional. Code of Gilbert Sec. 10-40 adopts the "International Green Construction Code 2018 Edition" by reference, stating it "shall serve as a voluntary code to encourage regulation of the impact of buildings and structures on the environment," rather than a mandatory permit requirement enforced like the town's other technical codes.

Electrical work in Gilbert must comply with the "National Electrical Code, 2017 Edition," which Code of Gilbert Sec. 10-32 adopts by reference and files with the town clerk for public inspection. Because Sec. 10-50 lists Sec. 10-32 among the enforced technical codes, unpermitted or noncompliant electrical work can draw written notice, a citation, and escalating civil penalties.

Marching, demonstrating, or gathering more than 500 people in Gilbert requires a special event permit under Code of Gilbert § 15-52 before you step off. Parade organizers must file with the Parks and Recreation Department at least 60 days ahead; other public assemblies need only ten days' notice, and funeral processions, school activities, and spontaneous news-driven gatherings are exempt.

Reserving a Gilbert park facility, sports field, or riparian preserve for a scheduled team practice, class, tournament, or private gathering requires a reservation permit from the Parks and Recreation Director under Code of Gilbert § 46-2. Bringing tents, inflatables, generators, or amplified sound, or launching five or more model rockets at once, also triggers the requirement.

Any Gilbert special event that will sell goods or food must submit a vendor list with its permit application and follow transaction privilege tax and food-sale law, per Code of Gilbert § 15-50(c). Organizers also owe five-day street-closure notice, town service fees and police-protection costs under the same section.

Placing any structure, object, or grading work in a Gilbert public right-of-way requires an encroachment permit from the town engineer under Code of Gilbert Sec. 10-326. Applicants submit dimensioned plans showing location, dimensions, utilities, access points, and height, pay council-set fees under Sec. 10-327, and carry $1,000,000 per-occurrence and $2,000,000 aggregate liability insurance naming the town as additional insured before starting work.

In the Town of Gilbert, the property owner or occupant, not the town's public works department, is responsible for keeping the public sidewalk in front of their premises clear. Code of Gilbert Sec. 54-5(a) makes it unlawful to let grass, weeds, rubbish or overgrown vegetation obstruct the sidewalk or interfere with public travel.

Gilbert bars placing or maintaining anything on public property, including sidewalks, that blocks free passage or interferes with a lawfully conducted business, under Code of Gilbert § 54-1. The town can immediately remove or impound obstructions that threaten emergency access, traffic or public safety, and owners face civil citations plus impound and storage costs.

Gilbert exempts air-conditioning, pool and spa equipment from its noise code only conditionally. Code of Gilbert § 42-61(c)(1) requires the equipment to be "properly functioning in accordance with manufacturer's specifications" AND to meet the residential community noise standards in subsection (e): a broken or oversized unit can lose the exemption.

Gilbert exempts emergency generators, storm sirens and alarm devices, plus their authorized testing, from the town's noise-level limits, but a portable or standby generator run for routine, non-emergency power must meet the same community noise standards as any other sound source: 45 dB(A) overnight in residential areas.

Code of Gilbert § 42-293 bans camping in any town park or public place, full stop, unless the parks and recreation department has issued a special-use or reservation permit under the town's established procedures. The rule sits in Division 6. Urban Camping, defined broadly in § 42-291 to include tents, bedding, cooking, storing belongings, or living in a parked vehicle.

Code of Gilbert § 42-292 makes it unlawful to lie, sleep, sit, or camp on any public street, alley, lane, parkway, or other public right-of-way in town, whether dedicated by fee or easement, with only a physical emergency or administering medical assistance excepted. It's a companion to § 42-293's park-camping ban, both added by the same 2014 urban-camping ordinance.

Gilbert bars e-scooters and other micromobility devices from riding in designated bicycle lanes, though electric bicycles are the one exception allowed there. Operators who ignore the restriction, or any of the article's other rules of the road, face a civil citation from the town.

Code of Gilbert § 62-102 bars any company from renting micromobility devices, including electric scooters, on town property or rights-of-way without the town's express permission, and § 62-103 confines where those scooters may then be ridden once a permit exists.

Code of Gilbert § 62-101 defines Class 1, 2, and 3 electric bicycles by motor assistance and top speed, and § 62-103 lets all three operate on streets posted 25 mph or under, but bans Class 3 e-bikes from multi-use paths and sidewalks where Classes 1 and 2 are allowed.

The Town of Gilbert requires a signed use agreement and town-authorized connection before reclaimed water is delivered to any property, and only public works department staff may turn it on. Unauthorized connections, resale, or plumbing that doesn't comply with the code are all prohibited.

Gilbert bars new artificial lakes and large turf areas from running on the town's drinking-water supply. Under Code of Gilbert § 66-356, any artificial lake built after October 8, 1996 must be filled with reclaimed water, and any turf-related facility of five acres or more created after that date must be watered with reclaimed water instead of potable water.

Gilbert's downtown sits inside the Heritage District Overlay Zoning District, where the Land Development Code requires every new project to follow Town Council-adopted Heritage District Design Guidelines. The overlay protects the area's historic character, favors a compact walkable core, and layers extra architectural and streetscape standards on top of the underlying base zoning district.

Inside Gilbert's Vertical Development Overlay Zoning District, a project can trade extra building height and reduced setbacks for public benefits through a Planned Area Development rezoning. Base heights of five to six stories can grow to as much as 150 feet and 11 stories in some districts when the Town Council finds the project delivers enough of the amenities on the Development/Bonus Matrix, including residential density above 25 dwelling units per acre.

Gilbert's property maintenance code requires every premises in town to stay free of insect and rodent infestation and other noxious pests. Code of Gilbert § 42-316(d), adopted by Ordinance No. 2908 in June 2024, exempts natural or cultivated rabbit, bee and other wildlife activity that isn't a danger or nuisance to neighbors.

Gilbert taxes hotel and lodging operators twice under Chapter 58: a general two percent (2%) Hotels privilege tax on gross lodging income under Sec. 58-444, plus an additional five percent (5%) transient-lodging tax under Sec. 58-447, a combined 7% Town tax on top of any state and county transaction privilege tax.

A stand-alone smoking lounge, the zoning category Gilbert's Land Development Code applies to hookah lounges, cigar lounges, tobacco clubs and bars, is confined to five commercial zoning districts and layered with distance rules under Land Development Code § 5.1.12(A). A retail tobacco or vape store is a different use entirely, governed instead by the Code of Gilbert § 42-280 product-display rule.

Every pawnbroker operating in Gilbert must hold pawned or purchased items for at least 20 days after filing an electronic transaction report with the Gilbert Police Department, per Code of Gilbert § 14-206(a), on top of the Town business license and reporting fee required by § 14-203.

Operating a massage establishment in Gilbert requires a Town massage therapy establishment license under Code of Gilbert § 14-351, background-checked through the police department, and the business must close between 10:30 p.m. and 6:00 a.m. under Section 14-329.

Gilbert requires a Town sexually oriented business license under Code of Gilbert § 14-406, and the Land Development Code separately spaces these businesses at least 1,320 feet from schools, parks, places of worship, residential districts and homes, and 1,000 feet from another sexually oriented business or liquor-licensed establishment.

Tattoo and piercing studios in Gilbert may serve walk-in customers only between 8:00 a.m. and 11:00 p.m., a Land Development Code § 5.1.12(B) limit set because the Zoning Code classifies these shops, like pawn shops and smoking lounges, as a 'Non-Traditional Business.' A studio that wants to stay open later must first win a Conditional Use Permit showing the extended hours won't harm nearby uses.

Fixing cars at a Gilbert home is boxed in from two directions: the noise code bars repairing, rebuilding or testing any motor vehicle in a residential area between 10 p.m. and 5 a.m. if it disturbs a reasonable neighbor, and the home occupation rules require the garage doors stay shut and forbid outdoor storage of parts, fuel or solvents.

Code of Gilbert § 62-5 lets a private property owner authorize the town to post no-sale/no-parking signs and remove unauthorized vehicles for a $25 application fee, and separately lets police tow any vehicle parked without the owner's written permission or authorize a private towing carrier to remove it.

Secondhand and junk dealers operating in Gilbert must hold a Town business license and pay a reporting fee under Code of Gilbert § 14-203, and Section 14-206(b) bars selling or disposing of any secondhand item for at least ten days after the required police report is filed.

Smoking or consuming marijuana anywhere the Town of Gilbert owns, occupies or controls, plus any open space or public place in town, is unlawful under Code of Gilbert § 42-296. The only carve-out is for lawful law-enforcement activity. Violators face the Code's general misdemeanor penalty of up to $2,500 and six months in jail.

Gilbert bans loud, disruptive parties outright and can hold the host financially responsible. Code of Gilbert § 42-92 makes it unlawful for a responsible person to permit an unruly gathering, and § 42-95(a) sets a civil penalty of $500.00 to $2,500.00, plus liability for the town's response costs.

Code of Gilbert § 42-268 bans smoking in enclosed public places and workplaces town-wide, but carves out physically separated retail tobacco stores, up to half of a hotel's guest rooms, private veterans/fraternal clubs, and outdoor patios so long as smoke doesn't drift indoors. Section 42-270 backs that up outdoors, requiring smoking to stay at least 25 feet from any enclosed area where it's banned.

Gilbert bans motorized skateboards and motorized play vehicles from sidewalks, town parking structures and parks, wide or fast roadways, private property without permission, and any marked bicycle lane. Non-motorized skateboarding is separately restricted on posted town parking lots and parks.

Gilbert bans possessing or drinking alcohol in any town recreation facility or riparian preserve except at a short list of named venues under Code of Gilbert § 46-38. McQueen Park Activity Center, the Gilbert Community Center, Freestone Recreation Center, Southeast Regional Library, the Riparian Preserve and the University Building are the only exceptions, and only under a liquor license, permit or town agreement.

Code of Gilbert § 42-146 makes it unlawful to urinate or defecate in public, on any public street, alley, sidewalk, park or other public ground, or anywhere easily visible or accessible from a public thoroughfare, unless using facilities provided for that purpose. Because the section names no civil sanction, a conviction defaults to a class one misdemeanor under § 1-5(c).

Gilbert taxes businesses under a classification scheme in Code of Gilbert Article IV: each business activity, retail sales, construction contracting, advertising, restaurants and bars, and more, falls under its own numbered section with its own gross-income tax rate, most commonly two percent, set by Sec. 58-400 and the sections that follow it.
