How Cities Compare
These rankings are based on verified municipal code data, not opinion. A "strict" rating means the city has heavy restrictions, high fines, or outright bans. "Permissive" means few or no local restrictions beyond state law.
Most Restrictive
- 1Euless, TX
Euless does not recognize ADUs in single-family districts. A second dwelling with its own kitchen is a duplex under the zoning code and requires multifamily zoning or a zoning change to build.
- 2Keller, TX
Texas has no statewide ADU mandate, and Keller zoning does not broadly permit ADUs in single-family districts. Guest quarters without kitchens may be allowed as accessory structures, but rental units need PD zoning.
- 3Haltom City, TX
Haltom City zoning does not broadly permit detached ADUs on single family lots. Separate living quarters usually require duplex zoning. Check with Planning before planning an ADU or garage apartment.

North Richland Hills generally does not permit separate accessory dwelling units with independent kitchens or rental status in most single-family zoning districts. Second dwellings require a specific use permit or PD zoning, and the city treats unpermitted backyard apartments as duplexes requiring rezoning.

Delray Beach does not broadly permit detached ADUs in single-family zones. Accessory guest quarters and garage apartments are allowed in specific zoning districts under Land Development Regulations §4.3.3.

Arlington allows accessory dwelling units in limited residential zoning districts subject to Unified Development Code standards covering size, owner-occupancy, setbacks, and parking. Unlike California or Oregon, Texas has no statewide ADU mandate, so Arlington's local zoning controls whether, where, and how an ADU can be built.

Coral Gables strictly regulates accessory dwelling units through its Zoning Code and Board of Architects review. ADUs are limited to ancillary apartments in select residential zoning districts with significant size, design, and owner-occupancy requirements enforced by Development Services.

ADUs in Richmond County are strictly limited. NYC Zoning Resolution generally allows only one dwelling unit in R1/R2 detached-home districts covering most of Staten Island. A basement-legalization pilot is active.

Sacramento County permits ADUs and JADUs on all residential lots per Government Code 65852.2. Detached ADUs up to 1,200 sq ft, 4 ft setbacks, and streamlined 60-day ministerial review are standard.
- 2Dallas County, TXNot required (residential)
No county ADU restrictions. Texas counties lack zoning authority, so accessory dwelling units can be built without county zoning approval. No county building permit for residential structures. Septic capacity (TCEQ) and floodplain rules may apply.

Tarrant County has no ADU ordinance because Texas counties lack zoning authority. Texas has no statewide ADU mandate. ADUs are effectively unregulated, subject only to HOA rules and floodplain limits.

Brentwood must allow Accessory Dwelling Units on any single-family lot under California Government Code Section 65852.2, as expanded by AB 68, AB 881, and SB 13. Kennewick (Benton County, population approximately 84,000) is a Washington city subject to the state's 2023 ADU preemption statute, House Bill 1337 codified at RCW 36.70A.680 through RCW 36.70A.700. Because Kennewick exceeds the 25,000-population threshold and lies within a fully-planning GMA county (Benton County), it must permit two accessory dwelling units (ADUs) per lot in all areas zoned predominantly for residential use. Collin County has no zoning authority over ADUs in unincorporated areas. Santa Clara County complies with CA ADU mandates (Gov Code 65852.2, AB 68/881/SB 13, AB 1033). One ADU plus one JADU allowed on single-family lots up to 1,200 sq ft with ministerial approval in 60 days.

Temecula must allow ADUs and JADUs on single-family and multi-family lots under California Government Code §65852.2 and §65852.22. Recent state laws (SB 1211, AB 2533, AB 1033) expand allowed counts, ease parking, and permit separate sales. ADU permits are ministerial with 60-day review.
