How Cities Compare
These rankings are based on verified municipal code data, not opinion. A "strict" rating means the city has heavy restrictions, high fines, or outright bans. "Permissive" means few or no local restrictions beyond state law.
Most Restrictive
- 1Clarksville, TN
Section 5-607 caps yard and garage sales at two per year per holder, each no longer than three consecutive days. The building official keeps the record of when and where sales are held, so the count is tracked.
- 2Fayetteville, NCThree per residence
Fayetteville issues no more than three yard sale permits to one residence or household in a calendar year, and each permit covers no more than two consecutive days. A fourth permit requires proof of a change in property ownership.
- 3Overland Park, KS
Overland Park caps garage sales at two per household at the same location each calendar year. Joint sales with neighbors count against every participating residence. Estate and moving sales can earn a third sale by written approval.
Fewest Restrictions
- 1Wichita Falls, TXNo, for residents
Wichita Falls has no garage-sale permit. City code only regulates itinerant merchants, and it exempts anyone with a residence in the city.
- 2Virginia Beach, VANo, for occasional sales
Virginia Beach exempts occasional garage and yard sales in residential areas from both its door-to-door solicitor permit and its public/right-of-way sale permit, so residents can hold one without applying to the city.
- 3Pflugerville, TX
Pflugerville sets no annual cap on residential garage sales and no maximum duration. The Unified Development Code names garage sales as a permitted temporary use in section 4.7.2, attaching none of the day limits it places on seasonal outdoor sales.

Paulding County has no yard-sale permit, but sale goods and signs cannot linger by the road. Section 40-5(5) makes storing merchandise within six feet of a right-of-way beyond 24 hours unlawful permanent storage.

Garland limits garage sale frequency per household per year. Exceeding limits may trigger enforcement and require a business license. Each sale is typically limited to 2-3 consecutive days.

A typical garage sale in Sacramento needs no city permit at all. The permit requirement in Chapter 5.80 applies only to businesses like secondhand dealers, junk dealers, and pawnbrokers, and a garage sale only falls into that category once it exceeds the city's frequency or duration limits.

Lubbock does not impose a specific numerical limit on how many garage sales a household may hold per year. Occasional residential garage sales are considered a normal activity. However, operating what amounts to a continuous retail business from a residence could be treated as a home occupation subject to the UDC's home business zoning regulations. Code enforcement may investigate complaints about frequent or commercial-scale sales operations at residential properties.

Unincorporated Clay County does not license residential sales, so no county cleanup rule governs them directly. Leftover merchandise, signs and debris left out afterward can be abated as a public nuisance under RSMo 67.398.
